OH, sorry, I forgot how much of a threat a 90 pound autistic kid with a butter knife- you know, the serrated ones that don't even have a proper edge- is against three cops, two of whom are already holding him down. My mistake, I just thought that ethics was a think cops should probably have. You know this kind of shit doesn't happen in other first world nations, right?

SC Trooper (Sean Groubert) Shoots Unarmed Black Man Breaking the law... you mean like going back in your car to get the license he asked for? Or maybe being a 90 pound autistic teenager with a butter knife? Cops in the US are trained to treat any situation like a life or death one, and it shows. Ferguson may be much ado about nothing, but this cop worship seriously needs to stop.

Brown is a poor choice for the poster boy of a movement against police brutality. Garner on the other hand, I've found few who could use sound logic to justify the officer's actions. I've found people who tried, but they literally contradicted themselves or made up facts. Example, the first person I saw defend the cop said "the chokehold is against department policy, not illegal" and "the chokehold isn't excessive force because i is allowed by the department" all within the same comment.

Honestly for me, that case depends on some facts I don't know.

If the choke hold was one in the sense that he restricted air flow and crushed the fucker's windpipe (which I doubt since he mustered the "I can't breathe" thing), then yeah he should be arrested. That's not okay. However, if the choke hold was a more usual one in that pressure was place on the side to restrict blood flow, which is far less dangerous, then he should face whatever penalty is set by his jurisdiction since it is against policy.

Personally I don't think he should face jail time if that's the case, because the guy was resisting arrest and the maneuver should almost never be fatal under normal conditions unless held for an extended amount of time. The guy's health is likely what killed him if that was the case, but I don't know.

Also there's the matter of having a tazer, pepper spray, or some other tool to subdue him but I don't know what the cop had on him.

Overall though I don't really care, since I doubt it was racially motivated and it damn sure wouldn't have sparked nearly as much outrage, if any at all, had garner been a 300lb white guy.

Part of the morality issue I take up with it is the cop really didn't try anything else. There were 5 or 6 of them, which is more than enough to do a safe and controlled takedown, even on a man that size. Source: my experience Wrestling and playing as an undersized Lineman, so it's not exactly credible information. That, and once Garner was on the ground, they didn't let go of the hold. At that point, when he's on the ground, all you have to do is keep him down using combined body weight. Some people argue the "chokehold wasn't enough" because they still couldn't get his arms behind his back. To that I respond a firm "no shit" that they couldn't get his arms behind his back, because he was probably grabbing at the dudes hands trying to release the grip or in any form of panic that happens when you "can't breathe", or more accurately, have your oxygen supply restricted.

In terms of legality, the autopsy ruled that it was in fact the chokehold that killed him through compression of some organs I can't remember the names of; although I wouldn't doubt health was a contributing factor. The chokehold is against department policy, which got the officer's badge taken away. The officer was charged with excessive force and homicide, mainly going off the medical examiner's classification of the incident as "homocide", which medically just means human killed a human, not the same as the legal definition. In terms of excessive force, using a technique against department policy that results in serious injury or death of an individual SHOULD be illegal, though I'm not sure if it is. I personally believe the officer didn't mean to kill him, but his lack of malevolent intentions don't excuse him. I think he should have been tried for excessive force personally, not homicide.

Like in most police cases (white or black victim), there was no indictment. As an aspiring cop, I can say I'm disappointed. That video was horrific and brutal, and not what I want the badge to represent.
