fjlawyer (11/28/2015) [-]  The most important difference between them is that, for manslaughter, there is no mandatory life sentence, unlike for murder. It's more complicated than this, but basically, where a person kills another, he is not to be convicted of murder if his acts and omissions in killing resulted from his loss of self-control. And loss of self control cannot be premeditated, there cannot be a considered desire for revenge. So if you have a bat in your car, it would suggest you premeditated the murder and you could get a life sentence if you can't use manslaughter (loss of control) as a partial defence. Whereas if there's a glove, you can say it was for baseball and you're more likely to get off without a life sentence. They treat it the same way as an unregistered firearm in your trunk- except the registration in this case would be a baseball glove. TL;DR the baseball glove gives you apt excuse for having a baseball bat. You ain't gotta explain shit, you play baseball. Severeness of murder is determined by whether you planned it or if it was in the heat of the moment or even accidental. If you carry around both bat and the glove, you can just say you play baseball for fun and just happened to have a bat, which you in the heat of the moment, of course, used as the weapon. If you have only a bat, you'll have a hard time proving that you weren't carrying it with the intent to kill that someone, which would make your crime a lot worse. I'm not good with law or explaining, please notify if there was something I missed out.  actually, both mens rea and actus rea can be qualified by taking a baseball bat out of your car  Not to mention that if you are attacked outside your car it is much easier to make a self-defense claim if it is apparent that the baseball bat was not kept in the car as a weapon.  You only gotta worry about that in your commie blue states. Here in MS, you can carry a bat as a weapon of self defense and just be open and honest about it. I was pulled over by a state trooper recently and he asked if I had any weapons. I told him there was a pistol in my door, a bat in the back seat and a knife in the glove box; all for self defense. He asked me to take out my gun, and we just talked about how Ruger is a great brand and stuff. No ticket even. I love freedom so much #65 -
