Either way, if you slip the stores insurance pays. doesn't matter if the sign is up or not. Cuz, the customers are invited inside, or there to the benefit of the owners. The owners must inspect the store and remove any hazards. The sign is just there as an attempt to prevent this... they are taking a risk... (im a finance student, taking insurance courses).

She premeditated it and posted it onto a public site. It wasn't an accident, and even though they forgot the sign she was aware it was wet yet still "slipped" on purpose.

If a location (restaurant, theater, store, etc) has a wet floor, it is their job to notify customers, for if someone gets injured because of that floor, it is the company's fault either because they didn't clean the spill / dry the floor / etc, or because they allowed for such a situation to exist.

Putting up a sign means they're notifying people about the danger, so it's not their fault if someone gets injured. The person had full knowledge of the dangers and didn't act accordingly and fell.

In this instance, the person who took the photo clearly demonstrated full knowledge of the presence of water, and therefore the danger. Sure, the company should put a sign up, but since he saw the spill and there's evidence he saw it, it becomes insurance fraud since he willfully put himself in danger for no reason other than to sue the company and make money.

Question. What if the victim of said moist surface is blind and can't see a sign? Is it still not a liability to the company just because the sign was up?

I don't know, for sure. I work in a movie theater, and we always prioritize cleaning spills. We do have a few blind patrons that come in, but normally they either have someone with them or we help escort them to and from seats. I'm not versed in that particular case.

If you're wondering about blind people going to see a movie, we have special audio devices that describe what's happening on-screen.

So I did a bit of research, and of course it varies by state and by case, but it seems there's a general understanding of companies taking "reasonable precautions" with regards to things like this. A sign could protect them against a suit by a blind person who fell, as they still had the sign. Basically, the idea is that the company can't be held responsible for edge-cases. They can't be held responsible for every single unique person and their issues, only an average person. Similarly, I imagine they wouldn't have trouble if a developmentally-disabled person who couldn't comprehend signs fell, as there's no way for the company to reasonably handle that.

I hope that explanation makes sense.

tl;dr: As long as a sign works for the general public, it can be held as a defense in a lawsuit.

In your case the sign is not there to warn. But to ensure you have something to fall back on. "well there was a sign."

When I did retail it was the same case. Our freezers would sometimes just randomly stop working second grade garbage from my jew boss and thus start leaking water. We cleaned it up leaving the sign there to make sure people wouldn't be able to sue. Or atleast soften the impact by "taking action". aka warning them.

Depends i've monitered the cameras and i've not. Depends on the store. and those cameras that are fake are just distractions they're are Cameras near it. Shoplifting we need to have probable cause. We cant just get you because your a spic or at least we can say thats a reason . and then detention and the real police show up.
