You can try to press charges on whenever that happens but it won't always work, like say a forced handshake or something.  battery has a few different elements actually. (1) "A" acts (2) intending to cause a contact to "P" (lots of debate on what intent is necessary to cause contact I can explain further but it takes a while) (3) the contact is harmful or offensive (more debate on offensive) (4) "P" suffered an injury by the contact In this case if he does prosecute for the battery and proved it more likely than not in court (what you have to prove basically 50%+ that it happened) then he would get compensatory damages for being pushed. This would amount to literally nothing. thus he would only get nominal damages of $1. So even if he sued him he wouldnt get shit for it. | ||
