That is a city ordinance that contradicts both police training and state and federal regulation. Also, it is called a bilateral neck compression, because when properly applied it forces pressure on the carotid arteries not the throat. There are no known cases of this restraint causing a death.
The chokehold wasn't what killed him regardless.

That was originally reported in the NY daily news. The grand jury testimony stated that the contributing factors where chest compression in the prone position from being detained coupled with obesity, asthma, and hypertensive cardiac disease (high blood pressure). The single most important fact in this case is you can not resist arrest. If he hadn't resisted and had calmly allowed himself to be detained, he would still be alive. Regardless of what the arrest is for, the officers can't say "well this is pretty minor so we are going to ignore you"

While I agree that Garner in no way deserved to die and that perhaps Officer Pantaleo was guilty of some misconduct, let's not twist the issue and pretend Garner's death amounted to an execution by police. No one tried to kill Garner or intended for him to die, or even suffer harm. The police was trying to arrest him for a minor crime, and restrained him when he resisted arrest. Fairly routine stuff. A healthy, non-asthmatic person subjected to the exact same treatment would have been perfectly fine at the end of it.

The problem came from the police's decision to ignore Garner when he clearly stated he couldn't breathe, and possibly from Pantaleo's alleged use of a chokehold instead of a NYPD-approved means of taking down Garner.
