That's why I avoid communities and just find different things I enjoy. Basically avoid anyone that obsesses over a show or thing in general. There's a lot of things with communities that I have followed, but I always avoid communities.

Well if the situation is the man raping the woman, no matter how she was dressed the rape is wrong and it's the man's fault for not being able to control himself. Women wear nothing at nude beaches but (im sure there have been cases) i have never heard of a rape on a nude beach. My main argument on this whole situation is that rape was called simply because the lady said "If I did I was too drunk to consent." That is completely her fault. She drank more than she should have, she chose to go home with the guy, she chose to have sex. Why is it always the fault of the other person. That could have been guy on girl, girl on guy, guy on guy, girl on girl.

This is a hard conversation or situation to convey opinion via text. There is a lot that can be said and a lot of ideas that can be shared. The worst part about this in the long run is that more often than not actual rape cases go unreported.

Well let me ask you this... 2 incredibly inebriated people leave the bar and end up having sex. Witnesses say all night they were all over each other and invited the other home multiple times. They end up at one of their place. In the morning they are both remorseful and claim rape on the other. Who is right and who is wrong? What can you do here. Just because one person said yes because they were drunk and thought later that it was a bad idea doesn't mean the other person is in the right mind enough to say no just because the other is drunk.

To me this story the way it is written out she decided to go out with the intention of meeting and flirting with someone. She knew her limit but passed it anyway then ended up doing something she regretted. Rather than just say "I fucked up" she is saying it's his fault.

When I was in the Marine Corps I was briefly PMO (Marine equivalent to a cop) we had a call that a girl was crying rape. We got to the barracks to find a guy in her room laying there confused as to why we came in and he was very cooperative. We spoke to a lot of witnesses from the bar from earlier in the evening to include the girls roommate who said that she was completely all over the guy in the bar and invited him back to the room for "some fun" then asked the roommate not to come back that night. Well i guess mid "fun" she decided she didn't want to do it and then cried rape. It's hard to know what to do in this case but it is similar. I got out before I found out what happened with the case, so there is no final result. I just thought I would try to voice my opinion on the matter.

Generally, it's the mans fault. I know, sucks right? According to the law, women are always the vulnerable party. That's if, unlike your story, there are no witnesses.

In the first scenario I didn't mention a sex at all. It could be 2 guys or 2 girls. Then how would it play out. It sucks that it usually weighs on the man's shoulders.

In a gay male scenario, it would be the one who is vulnerable, this is determined by seeing which one has had reported assault in the past. Assault can be homophobic comments made to them, beatings they've received because of their sexuality, etc, etc.

I don't know about a lesbian scenario, that would require some research.

So what you're saying is that if guy1 and guy2 go out and end up back at guy1's place. if they both claim rape but guy1 has reported in the past being belittled etc, then it is guy2's fault? Shitty to say, but odds are in a case like this they have both been mistreated.

I also don't know why that would be different in the lesbian case. you'd think the homosexual clause like that would go both ways.

I have to disagree, the only cases where you are "too drunk" is when you're not concious anymore or you've lost coherent speech. If you've put yourself in the position to possibly make that choice while under the influence then you should take responsibility for it. Just replace sex with driving, should drunk driving be okay since they couldn't rightfully make the choice not to drive under the influence?

Regardless of your opinion, the law says that very drunk sex is rape.

I'm assuming you know the perfect limits from "drunk" to "very drunk" right? I consider very drunk to be incoherent or unconcious.

I'm only working on knowledge Ive been told by my parents, people running a sex ed talk at my school, and what I've read up on.

Basically, if a woman seems in anyway inebriated, it's best just to leave here alone. Maybe take her to her flat or something like that, but sexual activity is not safe.
