She was a teacher and he the student. Even if he was 18 a lot of people would most likely still look down on it because she could take advantage of the fact that she is the teacher. She could have convinced him to have sex with her in exchange of something. But giving him anything such as a higher mark would be against the rules. It is extremely hard to prove if a teacher judged unfairly on assignments, because there is no objective correction model. She can easily give him a higher grade without anyone knowing it is because they had sex. This can play a part in whether or not a students accepts the teachers offer, especially if the students grades are not that good. The student might have sex while he rather wouldn't, just because he feels pressured to do so to higher his grades.

Of course this doesn't have to be the case at all. But it is a matter of professional behavior. Imagine someone on probation sleeping with their parole officer. Sure it can be innocent, but it can also influence how the parole officer treats the offender in an unfair and possibly unjust full way towards other offenders.

And regarding the age of consent, I agree that it is a bit silly to prosecute someone of statuary rape when it involves a 17 year old. But we must put a line somewhere. If we don't, were would it stop?
