The legitimacy of theft varies by circumstance.

Stealing a track from Metallica, for instance, or downloading a ROM of a game that is no longer in production is different from taking revenue away from a starving artist who's legitimately trying to make a living.

However, the issue is not that piracy is still theft - it is, unquestionably - the issue is that the draconian laws and restrictions imposed to prevent piracy often drive people to pirate games in the first place, resulting in losses for their own bottom lines. Customers have told them over and over that they're only harming themselves, and yet they persist with horrid boundaries that often make pirating a piece of media easier and more rewarding (money not even taken into account) then legitimately purchasing the game/movie/music/whatever. Censorship and Piracy Prevention often end up doing the opposite of their intended purpose.
