Pretty much what everyone is saying is that you would only get in trouble if you were stupid enough to say that the nails were there to pop tires.
No, you're liable regardless. It's bullshit, but it's the truth. Thieves has sued people they were stealing from because they hurt themselves after breaking in by falling down stairs and shit.
Yet another example of bullshit laws meant to be challenged in court until something changes.
Thats when you calmly remove your spikey piece of wood before the cops can come.
Unless y'know.. it's on your property.
Or are you seriously telling me in the US you're not allowed to defend your property from illegal vandalisation?
Yeah, you're not allowed. If someone hurts themselves on your property (even if they're trespassing), you are liable. Thieves has sued homeowners for hurting themselves while burglarizing someone's home.
You are, but traps left out are illegal.

I've done it... asshole took me to small claims and I won.... my defense was that I placed placed long nails through them to keep the wind from knocking them over since they always seemed to be knocked over every other day...
They'd have to be able to prove it was a booby trap. You could just argue that you were having issues with "the wind" knocking down your signs, so you attached it to some wood with a bunch of nails so it'd be harder for the wind to blow away.
Except no, they don't have to prove it's a booby trap.
"This term includes guns, ammunition, or explosive devices attached to trip wires or other triggering mechanisms, sharpened stakes, nails, spikes, electrical devices, lines or wires with hooks attached, and devices for the production of toxic fumes or gases."
Even if you just threw a board with nails that happened to be sticking straight up onto your front lawn, it's a booby trap.
>Trespass into power plant
>Sue and win, because muh booby traps
By your logic you could do this.. which is simply not true.
You have to have the ability to use it as a trap AND the intention to use it as a trap. You need to be able to prove both.
Flawed, you can't prove someone intended to use it as a trap so you'd never win in that argument. I could make a false stand with a 2x4 at the base with nails through it as "means to keep the sign upright" and then if they ran over it they couldn't prove I intended to use it as a trap, it was just the base stand for my sign.
That's..... what I was trying to say.
Sorry that was my bad wording, I meant Flawed as in I'm in agreement with how flawed it is.
I know who you are. I see you...
A booby trap may be defined as any concealed or camouflaged device designed to cause bodily injury when triggered by any action of a person making contact with the device.
This is neither concealed nor designed to cause bodily injury.
Or say that you believe in feng shui, and you think that this will increase your good karma and it will cleanse negative energy around the home. And you have this, because it's your religion.
Why don't you people just FORCE them to edit the laws? You people can force them into doing anything. You are hundreds of millions, they are less than a thousand.
Technically you could go for jury nullification.

Whose Line is a British show, lad.
what do you mean, HAD? Its still running, though a couple of days ago Sandi Toksvig became the new host. She's basically Stephen Fry if he was a Danish woman
even including being gay
and has been on QI as a guest 16 times
The Brits had Whose Line before the US did. It even had most of the US cast in it during the later seasons. It's pretty good once you get used to Clive Anderson.
