to me, feeling bad about a mistake is part of learning from it. you can't really learn from something if you don't take a moment and realize that you fucked up, and shouldn't have fucked up, rather than just being apathetic

I agree. You should feel bad about a mistake to learn from it. However instead of dwelling on that mistake, i think its better to, like you said, learn from it and move on

The law she is accused of breaking is fairly clearly spelled out, she knew what she was doing was wrong and did it anyway. why does that merit leniency on the law? consenting or not. if the people think a law isn't in the best interest then they have many proper outlets to change it for the future, in the meantime, she DID break the law and should be punished to it's fullest extent.
User avatar #47 - phudgepacker (08/11/2014) [-]
I do not think she deserves special treatment. I do agree with you that the law should be upheld at all times, regardless of the situation.

Again, the point of my original comment, honestly, was to express my opinion that the laws in place can obstruct our idea of 'justice'. Yes I realize that the law was made because in most cases this would be unacceptable. However, i think that to put a young woman on trial for "rape and sodomy" of an apparently consenting 17 y/o male, is not in the best interest of the people nor upholding justice. Thats my point

You are right though, the law should be enforced with no exception.

Even if he was 18, 19, or even 20+ it would still be illegal. A teacher is in a position of power over their students. Most students automatically trust their teachers, just because they're teachers, and the teachers can use grades to manipulate their students into doing things.

It also works the opposite way, because the teacher is in a position of power the student can manipulate the teacher to get the grades the student wants, because of this personal ties between incumbents need to be kept to a minimum with their subjects.
User avatar #44 - ancano (08/11/2014) [-]
no, the law sets a boundary.

that's like saying why arrest the 20 year old for drinking, he'll be 21 in a few months anyway.
do you see the problem with that thinking?
#53 - anonymous (08/11/2014) [-]
The whole not being allowed to drink until 21 is as stupid as the war on drugs.
User avatar #45 - phudgepacker (08/11/2014) [-]
I see your point. If people keep saying "he's X but will be Y in a few months" it sets a precedent to keep lowering the age of consent/legal drinking age or whatever. I get that. The only reason I made my comment is to point out that the law does not always play in the best interest of the people.

The guy who hooked up with this teacher most likely did it voluntarily (lets be honest she's hot). And, considering the fact that she is the one on trial for "rape" and "sodomy" charges, she was consenting as well. MY point is that this person is going to get fucked over BY the law because of these rigid boundaries. The law isn't perfect. I just think people often take it for perfect, and don't realize that you still have to consider all the facts involved to get a true understanding of what 'justice' really is.

teachers should not bang their students
User avatar #43 - phudgepacker (08/11/2014) [-]
OK, I know. My point though, is that the law is nonsensical. Had this kid been several months older, aka 18, this story would not exist. Because the law says so. Doesn't matter if he was a student. THAT's what i hate about this

I get your point, but the law states 17. Until that is changed, anyone of that age, male or female, needs to be prosecuted. Can't play favorites.
User avatar #38 - phudgepacker (08/11/2014) [-]
