| I think he was just doing that for intimidation. I don't see why you wouldn't have a round chambered already if you're going to assault someone. The dude kinda leans over and looks at the rifle as he's working the bolt, he might have seen that there wasn't a round in it. terminalinfinity (08/19/2014) [-] 2. The due process clause of the fifth amendment requires that an officer have probable cause that a crime has been committed before a detainment can be made. Officers are not allowed to stop you on a whim, just to investigate, or confirm suspicion without articulable evidence. For suspicion of an underage person, an officer needs 2 things for a detainment: 1) Evidence that the purchase was alcohol, 2) evidence that the person was under 21. Simply being underage and making a purchase at a place that sells alcohol is not enough. This makes the entire stop illegal. 3)Officers are required to clearly identify themselves as police officers when making a detention. The officer should not have waited until she got in the car to identify himself verbally, because it can be hard to hear depending on how thick a car is insulated. The article says the officer followed her out of the store. How hard would it have been for him to say while she was walking to the car "Ma'am, Im a Police Officer. I need to see if you purchased alcohol". A badge is not enough. Many people who are not law enforcement are issued badges. Health inspectors in my state have badges with the state seal on it. 4) It wasn't the police who dropped the charges. The police only file the charges. The prosecutor who got the case decided there wasn't enough evidence for it to go to trial, probably because he realized the entire detainment wasn't legal, and by the fruit of the poisoned tree legal doctrine, all subsequent crimes were nullified. The state wasn't being kind by dropping the charges, they were doing because they HAD to 5)how hard would it be to have these officers in an unmarked car like they do for stings in my city? It takes the element of uncertainty out of it. When you get to your car, they pull up and box you in, with lights flashing, so you KNOW its the police. #253 -

Put yourself into the shoes of a 20 year old girl: You're being followed by 3 older dudes through a parking lot late at night. They surround your car after you get in it and knock on the window. Now as you haven't committed a crime you're probably not expecting them to be undercover cops, and still might be pretty sketched even if a badge is flashed. Say all you want about how you'd act casually in the situation, but once the gun was pulled I don't think its unreasonable to panic. The problem here is that the cops were just doing their jobs.I find it hard to understand why municipalities feel such a need to devote the resources for undercover cops to stake out liquor stores. Especially when it's with the sole purpose of busting kids who are within years of an unrealistic age minimum. $40 million a lil' ridonkulous tho Her being 20 specifically was not the point of the sting though, almost 30% of all drunk driving related incidents are by those under the legal age to drink. They aren't arresting kids to be spiteful, they are arresting underage drinkers who can and will DRIVE a 2 ton vehicle through public areas. This girl was 20, probably within months of being able to buy booze legally. But that 16 year old isn't, that 14 year old over there isn't, etc. Granted, adults buy booze and drive as well, but common sense or lack thereof is a cumulative thing, one bad choice is not as bad as 2, 3, or 4 bad choices. #55 -

Hartlessrobuts comment was a suggestion to use officer's uniforms as a method of identifying police. I simply pointed out that fake uniforms are a possibility, hence it's not really a valid method of proof. I think pulling guns was a little over reacting. Not 40 million dollars so, but that's more a symptom of the sue happy court system we have. It was likely a legal adviser who put up that number. When you reach for the shift stick from the outside it looks like you're reaching for something when you put it in reverse. Some people have done that and BAM! they shoot at the cop with a hand gun. Both parties got spooked and it went into a downwards spiral. Didn't think about that, good point. Cops really are a little careful with themselves, justifyingly so i suppose. it's also why they tell you to keep your hands on the wheel if they pull you over. yeah the cops kind of like to live as long as possible You act subtle when you see a potential criminal reach out of your view. Maybe if the girl had been a little more level headed, this wouldn't have happened. Plus, the whole "Walk up to the car, flash the badge, ask to see purchases," thing WAS the subtle part. Besides, this story isn't half as bad as the ones you see/read about cops detaining people just because they don't want to do what they unlawfully request.
