In order to receive a death penalty you'd need two witnesses who tell the exact same story and who warned you that if you do that deed you will be put to death... So ya... if you fuck a dude in public and folks are shouting "DON'T DO IT OR YOU'LL BE KILLED" and you say "FUCK YOU I DO WHAT I WANT"... well then that's the death penalty...

And even then, a court that enacts the penalty will be called a killing court for 70 years...

It's really about the content, more like the concept, they were disrespecting their parents, but more importantly, breaking the law. Just because we have different morals now, doesn't mean we should simply regard biblical times as savages.
