Prior consent also doesn't count. If at 6pm, she is sober and says "Hey I want you to fuck me tonight," but the act doesn't occur then, the consent is considered null and void. That law is in place so you can't go rape your ex and claim she consented once therefore you can get it whenever you want. And unfortunately, usually it is word against word unless there are witnesses, blood/breath tests, videos, or any other definitive proof, which there usually isn't.

It's so unfortunate girls pull this shit and if it were me, and some chick was trying to say I raped her I'd tell get a lawyer and say she was trying to get away with raping me by playing the victim. Also something I tell all my friends (I don't drink so..) is to vine/instagram the chick giving consent. Vine or Instagram so you have the exact date and time.

Again, as long as she is drunk, even having a signed, notorized contract showing consent means literally nothing. A vine would probably hurt your case more than help it if she seems drunk in the vine. If she seems sober, however, you might be golden. Its a huge legal sink-hole that still needs to be fixed, but everyone needs to be protected, male and female. We obviously don't want people getting raped, but also we don't want people being falsely accused of rape.

Do you know how quickly blood alcohol levers drop? Like say someone gets absolutely piss drunk to the point they can't even stand on their own, but they wake up the next day having slept it all off, is it possible to test the blood to see how drunk they were the previous night?

A liver screen (to the best of my knowledge) will show if there is a history of chronic alcohol use, but won't show alcohol in the system if the blood doesn't. Since the liver filters out the alcohol and is what takes it out of the blood, I would think that it would dissolve the alcohol pretty quickly. I could be wrong on that one.

Well, I feel like that kinda depends on what kind of doctor you're looking for. For example, I (male) have my regular physician (male), my cardiologist (female), and my orthopedic doctor (male). However, if I ever found myself looking for a eurologist, I would probably find a female doctor. Same for proctologist. There are some things that I just don't want a male doctor to do.

I just remembered hearing about a case in the early 2000's in which the defendant claimed because he was also intoxicated, he was unable to determine if the sex was actually consentual. He claimed that if the plaintiff was in no state of mind to consent to sex, he was in no state to understand the difference between drunk-and-consenting and actual consent. I believe he actually won his case, so that may be a good defense, so long as you have a good lawyer and he draws heavily on legal precedent.

For all I know, you could have lost a loved one to cancer, and I would have just reminded you of that.
