There is no legislation for such thing. A teacher can take any course of action he or she considers adequate as long as it doesn't break the law nor the school politics.

The state government would have the faculty to decide that in the event of a trial. However, for those circumstances to happen the child would first have to confess the infraction to the parents, who (if humanity yet has hope) will not consider unfair the action taken by the teacher. Besides, I'm not completely informed in this part, but I believe there are laws that exempt educators from privacy laws if they consider that it's a necessary feature for the welfare of the child. If there are not, I will be glad to be corrected.

The sad part, however, is the need for this explanation.

But it should be apparent. They are children, and we came to the point that we can't educate children because they have the same legal weight as a grownup. I'm not complaining about what the commenters say, I'm complaining about how society has lead them to think that as the obvious path. The law shouldn't interfere with education unless it absolutely musts.

I believe that confiscating the iPad was a good solution. "see me after class" is not effective after certain age or number of repetitions. But if you argue invasion to privacy for this, it could also be applied for, let's say, confiscating notes the students are sending to each other. If you remove the authority of the teacher in the name of a liberal point of view, society starts falling apart from its roots. Children are not responsible for their own actions and must not be treated as such. If no reprimand is allowed, children will get away with anything, and then they'll keep that attitude through all their lives.

Locking their ipad won't stop them either. They'll crack it, obviously through the code given, and put on their own password and bring it to school.

Parents are not always the best first option and that resource should be reserved for severe infractions. I personally think that any parent that gives an iPad to an 11-year-old to take it to school without a good reason is not capable to discipline their children. Given that the infraction was minor, I think detention might be too much, and I'm not really aware of the effects of a referral as we didn't have them where I studied. If the fault persists, stronger actions should be taken, but in this case just confiscating it and giving it back after class should do it. The password change was a nice touch, as it reinforces the idea of why the child needs to pay attention on math.

Are you studying law? I was going to go into it, but I decided to go into medical school.

Anyway, for a teacher to go through a student's device, it should be for emergency causes. There was no emergency so parents should've been called, or a simple warning and detention should've been given.

The kid's only 11, you think there're parents out there who can afford ipads and are dumb enough to let their child bring it to school; let alone their first year of middle school? Chances are, he snuck it to school so don't blame the parents.

To your question: I wish I could say there aren't, but I've seen them. To your punishment: detention with an iPad will definitely not be effective.

I don't study law; my skin colour and economical status would make it impossible for me to get a job in my country, and even if I did, here is not a good place for it. I study Languages, because travelling to a better place is part of my dreams and the community of my university is by far the most tolerant and open-minded that I have found. I have a great interest in education, though, but that is also not a good field where I live. I have given up to my hopes in my country and now I wish to be in another one to start an international project I have been planning since I was 13. The only way to make this a better world is through education, and I will fight to death for that to happen.
