Maybe if you'd actually interpret the law rather than let your feelings and preconceived notions get the better of you then you'd realize that your example comes nothing close to how the law defines assault.

If you go up to someone and do a fake-out punch You know, make it look like you're going to hit them but you stop your hand short. , that'd be assault according to this law.

A punch that isn't made to land by any intention isn't an actuation of damage, or the intent of damage. Again. Shit law. If I tell you I'm going to burn your house down, that's a threat, which is plausible evidence in law. If I come near your house suggestively shaking a gas can empty or full, and rolling a lighter with no flint in it, it would constitute nothing but incompetence in using lighters and a capability to carry gas cans. To bias against intent without act is to start some Minority Report type shit. Which again, is bullshit as far as law goes.

It's actually a lot more simple than that (though you were correct). A baseball bat is actually considered a lethal weapon. They treat it the same way as an unregistered firearm in your trunk- except the registration in this case would be a baseball glove.

TL;DR the baseball glove gives you apt excuse for having a baseball bat. You ain't gotta explain shit, you play baseball.

Where I said 'It's more complicated than this', it was because there are several other tests that one must be put through in deciding if it's manslaughter. That little paragraph sums up pages and pages of legislation on the topic.
