The truth about the US drinking age is that states have the liberty to set one on their own, and the federal government actually can't set a nationwide minimum age. Back in the early 80's and prior, the drinking age varied by state more then gay marriage laws do today. The age, by state, varied from 18 to 21. However, in 1984, the federal government found a loophole that actually allowed them to set a nationwide drinking age. In the National Minimum Drinking Age Act of 1984, any state who had a legal drinking age of under 21 by a certain date would face a penalty of 10 percent of the money normally granted to them for highway repairs and other roadwork, which is actually a shit ton of money. No state wanted this to happen, so they all set their drinking age to 21. The only people subject to this penalty that chose to keep their drinking age at 18 is Puerto Rico.

The sad part about this loophole, it's completely legal. And the catch 22 is that the only people that can make it illegal are the ones enforcing it.

The "paradoxical set of circumstances" in this case is the fact that the only people who can put a stop to the problem are the ones who don't want the problem go away.

I wouldn't call that paradoxical.

It doesn't prevent those who want to remove the rule from putting themselves in that position.

It would be paradoxical if the only way you'd be in the position to remove it is if you were for it, but that's not true.
