You have hit upon the biggest plot hole in the DC universe. Everyone blames Batman for not killing the joker, but given the number of times he's escaped and the death toll every time he does, there is no rational explanation for why Joker has not been executed by now.
That's why people like the punisher because he gets rid of the bad guys, but the flaw with him is it's usually just nameless grunts.
Yes, he kills the bad guys.
And the good guys...
And innocent people...
and a hero once in a whille because a journal well no to hate said hero published a history blaming him of murder without any proof. That last one actually happened, spiderman was hunted down by him because the Daily Bugle published something amoung those lines. He is not a solution, he kills to satisfy himself, not to make the world better. If you kill the joker, he wins, he proofs we are all animals and that nothing matters.
But even that misses the point: why should a vigilante even have to be the one to do the deed? Given how many times these villains escape prison and how many people die as a result, there is no sane explanation for why they haven't been executed
. No need for anyone to play judge, jury, and executioner, you can get a real judge, a real jury, and a real executioner... the court system in Marvel and DC is a single, massive fucking plot hole.
And then he kills spiderman.
Unfortunately nobody will be able to create a villain that could replace the joker, so no matter how terrible his actions he will continue to escape, revive, or otherwise return to plague batman until DC stops printing.
You'd think they'd be able to make storylines where the really bad villians do die since they reboot a series every nano second.
The Dark Knight Returns has exactly what you need.
I'm sure there have been a few where he dies but generally its the 'I can't kill him lest I become the monster' sort of ending. I think a lot of stories with the joker could have him be replaced with a new character, but probably wouldn't sell quite as well just because joker is such flagship batman character.

nah that just means he cant kill aku. he can still just throw him around and beat him up without a care until aku grows bored and leaves.or just leaves because he got tired of having his ass whooped.
ALSO. it could be that the guardian has a similiar sort of divine weapon on his own person , after all we did see a lot of akus henchmen strewn about the battlefield, and i highly doubt aku would have allowed the guardian to remain as he is if he could have done something about it.
