you're wrong. if a parent takes a mortgage on a house and dies before paying it off, they can leave it to their next of kin in a will - whom then inherits the debt of the mortgage.

i'm sorry, but personal anecdote is not a plausible grounds for argument; this is known as a fallacy of composition (en.wikipedia.org/wiki/Fallacy_of_composition).

also, i don't think you need to insult me when talking - we are, after all, both adults. also, law suits do carry over from person to person. the lawsuit is not directed against a person, but rather their estate. that way, if unable to pay through monetary means, the courts can detract from their net worth (sell cars, etc.). And in this way, the debt can indeed carry over to next of kin.

Just go call your lawyer. I already had a huge conversation about this with mine no less than a year ago. My mom's debt was not carried to me. Nor did the civil lawsuit my dad was in when he died.

Even common sense will over-power you here man. You may be related, but it's not your life. You don't make their choices.

probably because they didn't leave it to you in a will. the house is your parents property; when they die, it automatically becomes the bank's because of the financing they have put into it, unless the parents specifically state they want it to be given to next of kin - essentially, the kin taking their place in the mortgage. Alternatively, the house may have been offered to your brother, as he was older, and he could have refused to inherit it, thereby giving it to the bank due to the financing clause aforementioned.

What I've said, if you look at my original comment, was almost never... Mortage cases are rare. Also it's one of the only ways debt will carry.

Like I said though, it usually Won't happen unless your parents are complete fucking idiots. So ask your lawyer, like I've said.
