Dude, they already have, this isn't a new development. People have been charged by companies for years under clauses like that, it's been completely legal. Very recently, like a week ago, congress began putting through a bill that would fine companies who did it Which is why I said "as the law stands now" but before this, nothing had been done and the fines and other penalties were upheld. Period.

Research on the latest with iTunes lawsuits. You'll see judges shut down their 100 pages terms of agreement. Simple markings as yes or signatures does not give the consent of the person when in a situation like the one these people would be facing. Furthermore the punishments that follow do not meet the crime for which they have violated (and they haven't violated any crime). The only people who have a special condition under the Constitution is the Military due to the "good order and discipline" as state by supreme court justices in 1976.

Well, it can't. I think there was a lawsuit and everything. They "enforced" the fine by using credit card numbers from those they could identify, which is patently illegal.

Another proof that the american credit card is really too permissive. It seems weird for me to think people having multiple credit card (and so multiple debt ...). Really strange system, it needs more regulation. I stop here before initiating a huge useless debate.

So the lesson is don't ever freakin use your real identity on the internet if you don't want trouble (like getting your id card stolen) .... It's the one and only rule, I've learned it by myself when I was only 8 years old. Hard to believe some people haven't figured it out yet.
