It doesn't work like that. Many states are required to make an arrest if a victim is alleging domestic violence. To reach that level the "victim" has to either have marks or have the home torn up. Either way at least in my state. The thought is the truth will come out in court.

See, the problem with that is that afterwards you gotta go home to the guy punching the shit out of you.
There's also the fact that abusive relationships tend to be very possessive, where the abuser's trust is so dependent on the prescence of the other that it will cling to it or, as it is an abusive relationship, order it to not go somewhere.
And you know what happens when you don't do as you're told.

Depends on the state, also some states require the victim to get a peace/protective order which under certain stipulations require the "suspect" to leave the home/not contact/not abuse/etc... till they go to court.

I didn't say i agreed with it but yes if the complainant receives an order they will be served by the sheriffs office and given a standby to get a couple things. The order is granted by a court commissioner and a crime doesn't even have to be committed to get one. They need to fear for their safety or the safety of their children and be able to put a pen to paper as to why they feel this way. The other party and the complainant will then have a court case within 3-7 days where they will stand before a judge to evaluate the legitimacy of such a claim.

yup welcome to our judicial system friend. It also puts LEOs in an extremely awkward position. We use discretion a lot in our job and regardless of whether we believe the complainant and sometimes even when we don't believe them we still have to enforce it. I have taken personal time to go to hearings about these things when i have believed the complainant is full of shit because it is so fucking stupid that they give that power to citizens. OH and i forgot the other key piece of information. All fire arms are seized pending the results of the order.
