But our instinct is literally: "If it looks good I want to fuck it" stealing something for money is not quite as important according to the human brain.
Don't get me wrong I'm not trying to justify rape I just think people need to draw a clear line on when the law goes too far.
If someone acknowledges the fact that they couldn't resist and that they couldn't withstand the pressure that person should however get a heavily reduced sentence in exchange for taking therapy compared to someone who acknowledges no guilt whatsoever.
If anything stealing bread because one is hungry is LESS logical than raping someone because they look good if we consider mixed messages and drunk girls throwing themselves at someone and then claiming rape.
It's our instinct to reproduce and women shouldn't abuse said instinct (neither should men but they get far less opportunity to do so) which they do.

What the person in the post is saying is that the motivation to commit a crime is used to defend the criminal rather than to prosecute them. And you can't really compare rape to being hungry.
The motivation however is an instinct. Lust in this case.
If someone who is overcome with rage snaps eventually and kills someone that person too needs therapy rather than jail time.
So here too the "asking for it" or admittance of guilt tactic works.
If someone torments you every day, every week, and all that rage builds up, eventually you'd snap and you'd probably get a pretty good legal defence using your motivation to commit the murder.
Same goes for theft. If you steal something because you need money to care for your kids or to take care of an ill family member it's a more "noble" motivation than stealing for thrills.
Motivation is one of the most important things taken into account when it comes to how a crime should be punished.
People act like this is a bad thing when it comes to rape while with every other offence taking the motivation into account is most elementary.
No they're saying rape is the only crime where the motivation can be used as a defense. Which is patently untrue.
