but sam, the owner/manager/front of house manager took the "tips" from the waitresses. so he had to specify when handing it to her that it was her money, not sam's. thus it is a gift, not a "tip" i see what you are saying, do you understand what i am?

That's still called a tip... a tip is property of the waiter and not the owner of the restaurant. So in reality Samy was stealing from the waitstaff. plain and simple.
