Actually, taking cocaine as an example (class A drug) and assuming that a small bag holds less than 3 grams of cocaine, then the mere possession alone would've been a Class D felony.

This could result in less than 10 years but 5 or more years prison time and/or a maximum fine of $250,000 and, with either of these, a Special Assessment fine of $100 per offence (in this case one) to fund the Crime Victims Fund.

However, under title 18 U.S. CODE § 2232 (a) Destruction or Removal of Property To Prevent Seizure: "Whoever, before, during, or after any search for or seizure of property by any person authorized to make such search or seizure, knowingly destroys, damages, wastes, disposes of, transfers, or otherwise takes any action, or knowingly attempts to destroy, damage, waste, dispose of, transfer, or otherwise take any action, for the purpose of preventing or impairing the Government’s lawful authority to take such property into its custody or control or to continue holding such property under its lawful custody and control, shall be fined under this title or imprisoned not more than 5 years, or both."

So, get rid of it for a maximum of 5 years or a fine OR 5 to 10 years and possibly a $250,000 fine on top.

Because in the image, the guy says class A drug. Translated across to the US, the possession of a similar drug, in my example cocaine(class A in the UK, schedule II in the US), is a class D felony.

Except one of the words is the cops word against yours, and cops can essentially get away with whatever they want anyway - even if you never had any drugs in the first place, if a cop said you did, you will be charged.
