Well I couldn't really tell. The only big difference between the two is that the AR-15 is the civilian model and only shoots semi-auto.

When a civilian has what looks to be an M4. It's best to assume it's an AR because getting any fully-automatic gun in the U.S. (legally) is extremely difficult.

True, but he could be a contractor or have a class 3 license, plus M4 is easier to type.
