Because, to my knowledge, Copyrights last for two years. Giving the original owner of the copyright plenty of time to build a successful business out of a worthwhile idea, and giving opportunity for others to approve upon this idea.
If my math and age are correct, 1990 was more than 2 years ago. I know there are other, better examples, of more recent games, but still.

I'm pretty sure copyrights last the length of their creatores life + some extra years, but usually in games and the such they can only copyright the characters, "lore", and mechanics. It doesn't take much to change the mechanic of a game into something that can fit under a different copyright.
