I have a question...sex with drunk girls is considered rape since they are not on conditions of a proper judgement, right?
what if the man is also drunk? he didn't have a proper judgement neither...then who rape who? can a drunk man who sleep with a ugly chick blame her for rape too? and who was phone?
Jeez, I'm sorry for this, didn't realized that I'd typed so much up.
It depends on the situation, intoxicated rape would be when the woman is so **** faced that she couldn't tie her shoe laces for example. So drunk that the person dragging her back to his place could be king kong and she wouldn't know the difference.
If a guy was equally drunk then sex probably wouldn't be on the cards, because he wouldn't be up for it himself.
When people talk about having sex with an extremely drunk girl, generally she's passed out and some guy sees that as free sex. An equally drunk (by proportion) guy would probably be in the same position.
Personally I don't think that if both parties were so
out of it
that it could happen, but for arguments sake, no rape has occurred because neither party has given consent for the other to have sex with them. In a way it makes both parties equally consenting, and neither party has gained from the situation.
I have had an instance where I was the one too drunk to reciprocate consent to my girlfriend at the time. I'm not sure how it happened, obviously I was a light weight and she wasn't, but it turned out that I was pretty much passed out when she initiated and I was completely gone about mid way through until I woke up in the morning. I realized that I'd probably had sex because I'd woken up completely naked I don't sleep naked, so I asked her and she told me.
I honestly have never looked at this affair as a rape, personally, however if it was the other way around I feel as though I'd have taken advantage of the situation. She was my girlfriend at the time, my reaction would have been different had it been a stranger.
A side note: when I was drunk and my girlfriend had sex with me apparently my body really didn't want to perform, since I've never had that problem before, or since it's been chalked down to the alcohol. But a male has to be in some state of arousal in order to perform, in which case it is harder to rape a male than a female.
Of course this point stands only for male and female intercourse.
Shame on you for making **** up.
Intoxication of any level, even one drink, prohibits any consent from being given. Ultimately, it's up to the jury or judge to decide who the rapist is in a case where both parties were drinking, but the setting is the main factor. (Where it happened)
Having one drink doesn't make you intoxicated... Intoxication is when you have taken too much, too quickly. The levels of intoxication would start from Intoxicated, not from 1 drink.
With one drink you are still legally allowed to drive.
But of course this depends on the drinks, and if you had actually read my comment you'd see that I didn't make anything up, I gave me opinion and shared an anecdote.
And I never said anything about giving consent when drinking, if you reread it.
I have to take a sexual assault class every 6 months, being in the military. I hear the same thing twice a year, and have for the last 5 years. You are wrong, and I am right. If I'm not, then show me the reference.
Tell me what you are even referring Simply saying "I am right and you are wrong" is not remotely close to a discussion.
So you are saying that one beer is too much to give consent to sex? Yet you can consent to literally anything else, including driving. I'd really like to see the article or the lecture that you've been receiving twice a year.
First off though, tell me which side of the argument that you're on. Because you sounds like THAT guy.
And I don't need a discussion. I'm simply giving you the facts.
If there was an undrawn line on how many is "too many", then it isn't specific enough to be written as a law. How about you stop trying to prove a point you have no basis on, training on, or references on, and let someone who knows the material teach you something?
Not good enough? I don't give a flying ****.
Mate, you really aren't making any sense...
You are literally just saying "Look, I am a professional, I know this stuff, you don't, so there".
You haven't actually said anything relating to the content or my comment, I'm asking you what I said that you have a problem with, which you replied to by saying my standard of English is bad.
Look, I never said there's a standard of "too many" I'm saying that the people on Funnyjunk have it in their heads that a girl who's had 2 drinks has sex with a guy. Wakes up the next morning to realize they now feel like a slut then go to the police station to report that they were raped.
What I said is that most nearly all intoxication rapes are more complex than that and generally involve the male taking advantage of an intoxicated girl.
Your definition of intoxication clearly doesn't match the true definition if you think one beer counts as being intoxicated. Intoxication by definition is your blood alcohol level being above a threshold. This is different for everybody.
Seriously man, you're coming off as a dick.
Then it doesn't count as rape, but of course no one ever believes it because, well, he's a MAN.
Really, guys get convicted by the dozens just because somehow they're not as trustworthy as a woman even without evidence.
