1º I just watch Batman the dark knight the animation and he breaks both arms, one leg, the nose and paralyse the other arm of a guy. He could have killing him? Sure, but not only that makes him exactly like the same animals that he fights but would make the people start to think that is ok to kill, and all the crime fighting would be for nothing.

2º He end up killing the joker, what makes the police to consider him too dangerous and to be put down, not arrested, but killed. Now, try fight crime WITH THAT ON YOUR BACK!

3º I never saw someone complaining about superman not killing. That's a big ball sucking for the scoutter.

But i'm still giving a thumb to OP. The joke per se was good.

1) I would rather die than live like that in jail. And after you blow up a couple hospitals, boats, escape jail multiple times, then yeah, I would say it's alright too shoot him.

The police are morons from what I saw and heard, so yeah I guess it would be hard to kill, but Joker is nearly impossible to even keep in jail.

Well, there is Blackgate Penitentiary, but the reason they don't all go there is because many of them are labeled "criminally insane," and no other asylums are nearby, and Batman probably wouldn't want his villains going elsewhere because he can still reel them in if they stay in Gotham.

Can't argue with that.

In honesty, it's really bothered me how little Bruce Wayne has done to make Gotham safer. Yeah, in the New 52 he's doing restoration projects and whatnot, but most of his fortune he spends on nifty Bat toys and funding Batman Inc. He could easily have Arkham renovated or create more security surrounding the island, or invest in community restoration projects that inspire a friendlier community, leading to less petty crime.

I guess we'll have to chalk that one up to him not wanting to be Bruce Wayne at all :/

The not killing thing isn't up to Batman by the way. Why is everyone complaining that Bats doesn't kill. The goverments in the series have had plenty of time to stage an execution everytime he gets these psychos in and yet people complain that Batman doesn't kill them when that is the governments duty to decide? Batman just cleans up the mess after a retarded goverment, but doesn't want to get his own hands as dirty as those he prosecutes.

What I tried to say is that Batman shouldn't be held responsible for these guys still living. Hadn't he been around, Joker would have had no one to stop him. The bastard has even bested Superman on some occacions, and Superman would have died under those circumstances if not for crazy luck, or other heroes being around.
No hero should be held responsible for not brutally executing evreryone that are against their point of the justice window, then we get Injustice League.

I'm not saying that the man of steel would lose. I'm saying that the Joker have won before, that's not to say that Joker would beat Superman 10/10 times, only that the times he have done it, he has nearly killed him. But Superman would normally roflstomp him.

the "deaths" of joker are a common plotshield in dc universe to justify why he still lives.

he always escapes by "he was inside that building when it exploded i think he might be dead but no body was ever found" or he just "falls to his doom" or plain out stages his own death to get away.

Also, in Dc universe lore - Batman is technically a meta-human (same class as the super humans i.e his physical strength, high intelligence). He may not have superpowers, but that does not mean he does not have super human capabilities; he is also a hero. Ergo, he is a superhero ....

He is not super, he's a normal hero. I completely agree that he's a hero, there's no denying that. He is above average human. He has peak human abilities. Genius level IQ as well. But all within human standards. He does not go above what it means to be human.

you've just said he is 'above average human'. Now i'm not saying that anyone above average is superhuman, but i still maintain that Batman is a superhero (by comic book terms - which is where superhuman was for the most part coined)

he may be a far more realistic interpretation of a superhuman hero - but that doesn't not take away from that quality. He beat Superman, and even went up against the supernatural like Darkseid. After that and so much more, can you really say he does not go above what it means to be human (in terms of abilities/ capabilities)?

Superhuman - above or beyond what is human.

Batman does not poses superhuman abilities. But speaking of those fights... Let's be realistic now. Superman can move 7x the speed of light. There's no way in hell Batman, a human, can keep up with that speed no matter how much he trained. Superman would knock batman's head off before Batman can even blink or reach into his belt for that ******** ring of his. Which just want to add superman has been able to over power kryptonite for minutes at a time. He doesn't even need a second to kill Batman, let alone minutes. That ring wont be much use in a real fight and not a unfair one sided ******** fight Batman always has.

Regarding the actual fight between the two: you're applying realism to something that is kind of the complete opposite of that so there's a bit of a inconsistency there.

That's the equivalent of saying Bane would've easily killed Batman if we were being realistic. Just that, he wasn't able to = Bruce Waynce isn't just an ordinary human - he is above that - which is called superhuman colloquially; and meta-human in DC Lore terms.

Also, i know that Batman was intended to be ordinary by his creator (Bob Kane) - but if you actually look at all the things Bruce Wayne has done in his story you should quite quickly see he is more than that now because of the way he has been written.

okay i'll give you your initial point (and a thumb) coz i've mixed up my terms (the distinction between superhuman and superhero).

However, the primary point i was addressing was that anon said that batman wasn't a superhero. And even with the definition you've provided, he still fits that definition- a character does not need to have all the qualities to be a superhero. For instance you could have an character who has superhuman strength, fights against evil - but doesn't wear a costume - they'd still be a superhero.

you get what i mean?

and Batman DOES possess super human abilities (like his intelligence)- he just doesn't have super powers - thats the difference. I only mentioned the superman thing for some context to my point, and i get that superman COULD defeat batman easily. He just HASN'T been able to ever (at least in the comic book canon) because Batman's always been one step ahead (which is arguably in itself superhuman - being able to out smart Superman would be somewhat unthinkable for an ordinary human, hence Batman actually is above human.

Again, all i was saying was: in terms of the comic book definition (the most widely known one) of superhero - Batman is indeed a superhero.
