They throw away the stale ones and reuse the box to save money.

If it was raw meat or something, then probably, but seeing as you wouldn't catch salmonella from a stale donut, no laws are being broken.

Um. No it's not. As long as they are properly cleaned, and properly marked with the date, it is perfectly fine. Was a cook in a restaurant for 4 years, and had to take a test on this **** every year.
