Also, women's alcohol tolerances are different depending on where she's at in her monthly cycle. A week before she could have polished off a bottle of wine with a shot for good luck and been mostly fine. But somehow this week she's tripping over herself after 3 shots in the same amount of time. So in addition to other things that affect your tolerance (like what you've eaten, how hydrated you are, the amount of time between drinks) there's another big player that most women don't know about.

Don't get me wrong, I agree with the statement completely. If you're going to drink enough to put yourself in that position, you have no one to blame but yourself.

But the problem with drinking is that people remember things differently (or not at all). She may ONLY remember being at the party, then a dude inside her and nothing in between. She doesn't know if she consented. She doesn't know if she was even awake to say yes or no. Or if she had been roofied. The whole thing is a mess because of the nature of drinking, especially at parties like that.

1. The court will almost definitely side with the woman's memory as part of the push to end the "rape culture." Unless there are several witnesses on your side, juries will assume you're a lying rapist.

2. Even if she remembers saying yes, she can claim not to.
