It definitely looks like a 9mm. Its not jacketed though which is strange. Probably what kept it from penetrating the phone. He must have been at some distance too though because I've seen bullets pass through all kinds of soft and hard targets and a phone would be no problem at any reasonable range. It must have been a stray that traveled some distance and lost most of its velocity.
