Reverse argument. If you can show up with a SAFE kit (Sexual assault forensic evidence) and it shows evidence that the person over 18 had intercourse with someone under 18 (with the exception of a few states via the Romeo Juliet clause) and there was no proof that you are in fact the one that raped them, then you could sue them for statutory rape, even though they are 100% innocent of that crime.
