The question is presented as such; who would win in a duel? Duels are regulated; yes, you fight to the death, and naturally you would act in a disgraceful manner to assure victory - but in a duel, acting in a disgraceful manner will do nothing but assure your death, as the referee/judge wouldn't hesitate in taking your life.

In the absence of the referee/judge doing it, the state certainly would. Where duelling to the death was legal, breaking the agreed rules of that duel carried the penalty of death. I see no reason to assume that we wouldn't uphold such should such duels be allowed again in modern times.
