That is nonsense. Spider-Man was not in the Avengers movie, because they never even considered including him when writing the movie. Yes, if they had considered him as a member, it would have been an issue of movie rights, but that is not the reason why he was not in the movie.

And why should they have included him anyway? The founding members of the Avengers in the comics were Iron Man, Thor, Hulk, Ant-Man and Wasp. No Spider-Man in sight. Captain America joined in issue #4. Hawkeye in #16. Black Widow in #111. Spider-Man joined 18 years later in issue #329 as reserve member and later as part of the New Avengers. So it would have been quite a stretch to put him in the Avengers movie. Heck, even Mr. Fantastic and the Invisible Woman were in the Avengers before Spider-Man.

If they had added Spider-Man, they just as well could have added Wolverine, as he is also a "New Avenger".
