You can't patent a rectangle, but you can patent a curved rectangle with 16 movable squares and 4 stationary squares underneath with they exact same functions (phone, internet, texting).
Let me put it this way, if you're studying to become a lawyer. There's good money in it for you no matter what, even if you loose a case someone has to pay you. And Apple pays GOOD for its lawyers.
If you're not studying to become a lawyer, then you should realize that these companies are being overtly competitive. Instead of suing for design they should be focusing on dropping the price, like gas station companies do. Most gas stations look alike? No problem, but my gas is 10 cents cheaper.
Who gives a **** if it's similar? If it was the exact same people would just go for the cheaper or better quality one. I don't think Apple should even give a damn because if their phone is better then it will sell better. I personally am just going to stick with my Nokia so I'll never have to tell a story of how I broke my smart phone when I dropped it on my pillow.

so **** apple, they didn't invent anything, they just adapted, and now they are suing others saying "hey you can't use that, we stole it first!"
Yes, they do. Apple is a very specialized company. They need to make their product and brand name seem unique and special, and keep the market undiluted and competition for their niche low. Most of their profits come from the iPhone remember, and they cant afford a drop in popularity. A severe drop could cripple the company almost overnight.
Is it moral that they do this? Thats opinion based? Do they have the right to sue over this? Damn right they do, because the american patent system is flawed and allows this kind of thing.
That doesn't mean they *need* to. If those other products directly copied theirs, then sure - but their brand is more than that. Specifically, it's overpriced, pretty well made, and form over function. And this doesn't eliminate competitors, it just slightly set them back while endangering their own image. Plus, as they're finding out, they have opened a can of worms since their own products also use a bunch of past patents.
Well, they kind of do need to. They need to continue to dominate the market.
If the iPhone takes serious hits, then they dont have a hell of alot of other products to fall back on other than Macs, which make up a small part of their overall profit compared to the iphone. Samsung, on the other hand, has dozens of other smartphones, as well as a ******* of other products.
But it's not like they're really eliminating anything. If they were wiping out a company that would be one thing - but at the end of the day, they're just sort of strongly inconveniencing them
apparently samsung and a bunch of other companies that use the Android OS are going to sue apple for $100 billion, which is a pretty big chunk of money from apple
My house mate was telling me about that court case earlier today. My question is though, how can you make a device to compete with the Iphone that will not in some way resemble it? I mean all it is really is a rectangular touch-screen. What were they supposed to do, make it round?
A while back Harley Davidson Cycles tried to patent the sound from their exhaust because other motorcycle companies were copying the sound. The case was dismissed. Why did this case get a second glance from any judge worth his salt?

No, it is pretty much just form factor. For example one of the things that Apple is sueing over is the ratio of Bezel size to screen. Another is 3D looking icons with round corners. It is all ridiculous in my opinion.
