Yeah, they have to power to do so but not the obligation. There is no reason for states to issue marriage licenses. Look up the history of marriage licenses and you will realize that government marriages have a dark history.

you can force a hug, you can force the sex and call it under religion. and you can chose if YOU want to hug or have sex. i am just saying that sex would not be seen as a forbidden act. it would be like close human interaction. since it is religion, it can work around political barriers. as long as your religion has its temples, followers, written word, and belief system, you can establish any traditions. in some religions holding someones had is equal to saying you love them. in others, eating specific meats is forbidden, and some times you have to go extended periods of time without eating. religion can make weird rules. just because one person does not accept them all, does not mean the rest wont either.
