It's common sense that you don't jump from one board to another... you should think for yourself and not do it in the first place; thus, if I would see someone doing someone THAT stupid, I'd let them.

And it wouldn't necessarily pass(the law suit) because of the personal responsibility thing, but you still don't want to deal with those kinds of things. I am an operations supervisor at a waterpark and we teach our guards to stop something before it happens for reasons like this. He could have gotten seriously injure or killed doing something like that and as a lifeguard (emphasis on the life) it is their responsibility to prevent that.

Yes, you get millions of fucking retards who do shit like this and even more dangerous stuff all the time. But you can't just turn a blind eye because they're doing something stupid on their own. It's your responsibility what goes on in your zone and your job to enforce it. If he had gotten hurt or killed doing something that obscene (more than likely he had done it more than once) it would be very likely that the lifeguard would face some sort of disciplinary action, had they done nothing to prevent it.
Spinals are serious business. Most lifeguards are teenagers and they really aren't prepared to handle that kind of thing. It can be a very traumatic experience for them and the guest around them. Preventing injuries from happening is a lifeguards responsibility.
