Hopefully it's only in the film briefly as a new armour to replace the Mark VII after it got smashed about a bit at the end of the Avengers; similar to how he has the Mark IV at the beginning of IM2. Then when the Mandarin inevitably creates some Second Act problems and ruins the tan Mk VIII he'll have to make a hopefully better looking Mk IX armour.

Looking good, but I'm not looking forward to the inevitable comparisons to The Dark Knight Rises, which will be used to make the film seem worse than it will be:
Alright the film looks to be darker than the previous two, but with the world-wide threat in the Avengers, they can't go back to a simple "villain copies Iron Man's armour for personal gain" as they did that in both the first two movies (money in first, revenge in second). The writers will need a bigger threat i.e. the Mandarin and possibly AIM (hinted at) - who are both after world-domination/control in the comics - in order to further develop Tony Stark's character.
People will also talk about how the arcing of the three films is similar to the Batman trilogy. In Batman the League of Shadows is introduced and then essentially forgetton in TDK and brought back in TDKR. In Iron Man, the Ten Rings is introduced, but unlike Batman, the head of the organisation is not killed (Stane become the big bad) whereas Ra's is in Batman.
