He could of easily have gotten new eyes -look at how many Danzo got- and in order to activate the eternal Mangekyō Sharingan one only needs to transfer new eyes from another donor. Plus those brothers are the strongest Uchiha whose Sharingan abilities are equal to each other. Madara and Toby are the only people whose sharingan can control the Nine tail fox which means the only person left with that ability is his brother Izuna.
