Well...(just an idea) I can see how (I'll just add here I've never seen the show) that if the only survivor was arrested he'd be safer in jail perhaps because what if the killer still wanted to kill that person, like maybe they just hold him until they catch the guy

Also, for anyone who wants to watch it I would recommend reading it instead since first of all, the chance of another season is slim due to it not being as popular as expected and then I heard the anime skipped a lot of imported things in the first season

"Arrest" doesn't always equal jail, you can get arrested for questioning and leave the same day, or you can be arrested and jailed.
arresting is seizing you for interrogation, weather you're a victim or not
