User avatar #203 to #173 - armwulf (01/07/2016) [-]
Traveling is technically a legitimate argument. Federal law defines "Driving" as using a motor vehicle on public roadways for commerce.
Just driving to work isn't commerce, that's "Travel", which in many states doesn't TECHNICALLY require a licence.

If you're going to work, and you're getting paid, that's ******* commerce
User avatar #243 to #233 - armwulf (01/07/2016) [-]
Legal english is not the same as english
Legally, commerce is defined as: "The exchange of goods, products, or any type of Personal Property"
If you're traveling to work, chances are you don't fit that definition. Really, only tractor trailers and some small businesses qualify.

User avatar #217 to #105 - talldumbdork ONLINE (01/07/2016) [-]
Hopefully departments are all training officers on how to respond correctly with these particular kinds of idiots. Officers need to recognize the situation immediately (uncooperative asshole yelling about rights) call for back up for possible takedown and safety of officer and annoying person, and use escalation of force techniques while recording each step to defend themselves in court against the asshole. Most of the guys in the video took the steps and were patient. God knows I couldnt be that patient.

I'm glad these people exist because of funny **** like this Sovereign Citizens Getting Owned Compilation
#6 to #2 - soyfriedbryce (01/07/2016) [-]
Its like people dont understand not to patronize cops. They have a hard enough job already, dont make it harder by being a prick. They have every right to pull you out of your car, and EVEN IF all the ******** the "sovereign citizens" said was true and applicable under either federal or state law which is isn't by the way, my favorite are people who try to quote the articles of confederation as if those apply after the civil war it would be their word against the cops, the cop can just say they heard someone calling for help from the trunk, or that they got an anonymous tip about a weapon in the vehicle, and some ****** camcorder isn't going to be enough to prove that they didn't. Dont patronize a police officer, ever. Just be respectful, do what they say, and go on your merry way. And if you are committing a crime in some way, then deal with it like a mature adult and just ******* deal with it. If your speeding you'll get a ticket, if your smoking probably a ticket and a warning if its your first time, and if its not your first time, why haven't you gotten your **** together and stopped smoking pot in your car. There is no excuse for this kind of behavior.

Articles of Confederation stopped applying after the ratification of the United States Constitution in 1791.
#27 to #6 - anon (01/07/2016) [-]
As a guy who travels through Calais and Dover often (crossing the channel), I get stopped a lot by the police. It's to easy to deal with them. You're polite, you do what they say, and you're done!

The amount of time I've been stuck in traffic because someone was making a scene for no reason is incredible. One guy even tried to run and leave his car behind. Turned out he had been paid by a 'refugee' to hide him in his trunk. Didn't work out well.

Surprisingly enough, most of them know me quite well by now due to how often I travel through it. I rarely get stopped at customs anymore, and if I am, I generally have a little friendly chat with them. They're good people, and have provided me with ample stories of weird and funny things happening there. Got complimented on my French too, even though it sucks. Although they're probably used to dealing with people who refuge to speak French and expect everyone to speak either English or their mother tongue.

ohemgeezus, stop blocking me man.

Except lying is illegal, since it's falsifying evidence ( or in this case, making the evidence up, which is not allowed). Word against word are meaningless and void.
#179 to #176 - soyfriedbryce (01/07/2016) [-]
Yes, lying would be illegal, but people do it. A camcorder isn't proof that the officer didn't think he heard something from the trunk, or proof that some random asshole on the side of the road didn't shout "HE HAS A GUN IN THE CAR" before the guy started recording. And when it comes to any case with a jury, word against word is very important. Because you arn't convincing the judge, your convincing the jury, who have no real law training and will be biased towards whoever has the best case. In most cases between a police officer, and the kind of people in these videos, who appear to be quite loud and rude, the officer is going to have more sympathy. It all comes down to who can garner the most reaction from the jury. Of course most of these wouldn't even be brought into that kind of trail, most of this was probably just a fine or something along those lines, except for the ones who were actually arrested, but regardless, its not unusual for a police officer to use the excuse that they thought they saw a weapon, smelled pot, heard a voice, or something along those lines in a case that most likely wont be scrutinized. Used to work with the police all the time when I was with the fire department, I know my fair share of both good cops, and asshole cops, and trust me, there are a lot of both. But regardless of which you get, you should just not patronize them.
#180 to #179 - skebaba ONLINE (01/07/2016) [-]
That's why juries should be illegal. They are biased as **** , unless we get a robotic jury. Just as witness testimony is practically useless in reliability. Just put CCTV with sound to monitor every inch possible, so you will always have 100% proof whether someone is innocent or guilty.
User avatar #193 to #180 - inyourmind (01/07/2016) [-]
Most states allow the defendant do demand a bench (judge) trial rather then a jury trial if they wish for it.
#263 to #193 - skebaba ONLINE (01/08/2016) [-]
Good. I can see many choosing the bench, unless they are the most charismatic human in existence, where they can get away with pretty much anything if there is a jury.

User avatar #191 to #6 - inyourmind (01/07/2016) [-]
Never consent to a search of your vehicle in any situation and you can contest the whole "i heard someone in the trunk or anonymous weapon tip" in court rather easily the judge will require that they prove they got the tip (about a specific illegal weapon as having a firearm in your car is not grounds for it being searched) and that they found someone in the trunk or they will drop the charges based on illegal search grounds. This does happen quite often actually.

The rest of what you said I completely agree with though. No point to be rude or hostile to police officers. They have a stressful job and like anyone else the vast majority of them do deserve respect.

When you're gonna go to jail, verbally fighting the cop versus just saying "Yeah, I'm in the wrong here, cuff me" could be the difference between 6 months in jail and 2 months in jail followed by 4 months of community service.
User avatar #65 to #64 - ashedust (01/07/2016) [-]
Should clarify: This is if you're caught doing something that could potentially get you thrown in jail.

Sorry.

is "Sovereign Citizen" even an actual thing?
#160 to #143 - justtocomment (01/07/2016) [-]
It was covered in the article of confederation. However there three major points that need to be clarified
1) The Articles of Confederation are not valid as of 1789 - so anything they say has no bearing on American law.
2) The term "Sovereign Citizen" was to effect people travelling between states and provinces in the United States, effectively saying that anyone inside the borders of American states/territories was to be given the same rights as actual citizen AND
3) those same travelers would be held to Federal and State law where applicable.
So to sum up: "Sovereign Citizen" doesn't mean what they think it does, and even if it did the legal precedent has been invalid for over 120 years.

Doesn't the Magna Carta only apply to the UK?
#7 to #5 - anon (01/07/2016) [-]
Yeah, and if memory serves me right it was about restricting the King's rights I believe the situation was King John fought unsuccessful campaigns in France to retain the English Lord's lands and kept raising taxes so the Lords rebelled and forced him to sign the Magna Carter to force a pseudo-government. But I might be talking out my assignment so you might want to double check that

This poem kinda explains it pretty well if you don't want technical knowledge, my grandfather used to tell me it heaps.
John, John, bad King John
Shamed the throne that he sat on;
Not a scruple, not a straw,
Cared this monarch for the law;
Promises he daily broke;
None could trust a word he spoke;
So the Barons brought a Deed;
Down to rushy Runnymede,
Magna Carta was it hight,
Charter of the People’s Right,
Framed and fashioned to correct
Kings who act with disrespect –
And with stern and solemn air,
Pointing to the parchment there,
“Sign! Sign! Sign!” they said
“Sign, King John, or resign instead!”

John, John, turning pale,
Ground his teeth and bit his nail;
Chewed his long moustache; and then
Ground and bit and chewed again.
“Plague upon the People!” he
Muttered, “What are they to me?
Plague upon the Barons, too!”
(Here he had another chew,)
But the Barons, standing by,
Eyed him with a baleful eye;
Not a finger did they lift;
Not an eyelash did they shift;
But with one tremendous roar,
Even louder than before,
“Sign! Sign! Sign!” they said,
“SIGN, KING JOHN, OR RESIGN INSTEAD!”

I love people like this.

Yes, you're being detained.
Yes, this traffic stop is legal.
Yes, even this sobriety checkpoint is legal.
Yes, "asking" you to step out of the vehicle is a lawful order which you must follow, or you're breaking the law.
You may consider yourself a "sovereign citizen", but you have to abide by local, state, and federal laws while you are anywhere within the borders of the U.S.
Driving is a privilege, not a right. This traffic stop would have been over 25 minutes ago if you just provided your information.

Is it smart/necessary to be a dick to a cop?
No.
The thing is, people don't understand cops are given a quota system. Like stop and frisk. Even if you've done nothing wrong, they have to go out of their way to look for **** you've done wrong even when you havent.
Of course, there are also cops that go out of their way to be dicks because they can abuse this system. thelibertarianrepublic.com/horriffic-cops-force-open-mans-anus-hospital-find-drugs-bill-video/
It's easy to say all cops are pigs or all rights proclaimers are jerks, but it all depends on individual circumstances. Sometimes it's a guy trying to get away with driving without a license. Sometimes it's a cop abusing their power. I'm just saying don't generalize and ignore the overarching problem that is unreasonable stop and search quotas.

Lots of places don't have quotas. In my state (California), quotas are illegal.
www.leginfo.ca.gov/cgi-bin/displaycode?section=veh&group=41001-42000&file=41600-41603

There's more to the story than your article lets on. For one, that guy has a prior conviction for using meth and is a known drug dealer/user in the area. For another, a canine alerted on the seat of his car. And those things taken together gave a judge cause to issue a warrant for the search.
All that being said, it's still absurd. Drugs shouldn't be illegal in the first place and we shouldn't be probing around inside people's buttholes, as a general thing. That's probably why the guy won a $1.8 million settlement.
#187 - deepterror (01/07/2016) [-]
If he was speeding, he should have stated that at his premise instead of threatening to extract him from the vehicle. Non compliance past this point would be unlawful, but compliance when no reasonable suspicion of a crime is presented upon request is not illegal. Both the guy and the cop were dickheads.

it is infact unlawful for you to refuse any request from a police officer that does not put you in harms way if you are at an active crime scene or are being investigated. Which could be for anything the officer chooses (suspicious vehicle etc)

a man near my town was charged because an officer was placing lady under arrest and she was freaking out and the officer asked a bystander who was watching to retreive the keys from his car and lock the door. The man told the officer to "eat **** "
#251 to #248 - deepterror (01/08/2016) [-]
I am not sure where you live but I live in Canada and just as the US has, we have rights that guarantee certain rights. One of those rights is that you do not have to provide personal information simply upon request. It is legal for an officer to ask, but you do not legally have to comply until you are presented with reasonable suspicion of a crime.

There are certain exceptions though, such as when the authorities are investigating another crime that they know is going on, but are asking you for info because even though you are not at fault, you could have important info about a crime. An example would be someone who witnesses a murder but does not want to give info. That is illegal to do.

TL;DR Police must have at least reasonable suspicion when requesting info from a citizen under standard circumstances. When reasonable suspicion has been established between officer and citizen, non-compliance past that point becomes illegal.

this story shows both sides of the story. cops in inner cities are tense due to the crime, and now the increasing hatred towards them. blacks are angry because of ****** up **** they see on the news and social media about police. world peace isnt achievable, at least not right now, but why the **** dont we all just try to chill out and make our communities a better place instead of flipping **** on each other before anything even happens. you know damn well that guy only pulled over so far up because he wanted to be a dick to the cop, which shows his pre-conceived notions about cops, and we all know the cops feelings
