I disagree with you. If the collision is not your fault, park your car, put on hazard lights and WAIT for traffic to react to the situation. Then take some damn photos so you can win over the bastard that smoked your ride.
From the look of things the guy had been standing there for some time. It's not his fault the asshole filming didn't react.
You should park your car off the road though. Especially since that looks like a major series highway, and at the increased speed of those roads and the expectation that everything will be moving forward at relatively the same speed on those roads, the people in those vehicles wouldn't necessarily have a lot of time to react.
when you need to stop like that you have to put a triangle in the road to warn people about a stopped car ahead. its enforced by law to have one. idk about other countries.
That's the case here, too. However - it looks like the car might have stopped unintentionally, so they didn't move. Nobody's crazy enough to stand around in traffic.
It's standard even for 2 or 3 lanes in America, never the center lanes. Either an outside lane or the shoulder. People don't keep cones/triangles in their cars.

Honestly, looking over the gif, given where the filmer is and where the black vehicle is, the driver of the black vehicle is a ******* retard that doesn't know how to drive.
Clearly there is room in the lane to his right if you observe that lane after he sends that poor dude flying. There is legitimately no room to change lanes into the left lane. Based on how the driver of the black vehicle reacted to the vehicle in front of him as well I don't feel they were nearly as alert as a driver should be, let alone the fact that they don't really appear to break at all until just before they run into the dude.
Sure, yes, they probably should have moved off to the side of the road, but that ******* moron of a driver should be doing more to ensure the safety of others on the road.
And lets not talk about the ******* SUV in front of him, which looks like they pinned someone in between the bumpers.
This gif went from being somewhat amusing due to the guy inverting the second he's struck to being infuriating. I see **** like this and it makes me want to end the lives of those not worthy of driving because they can't be ******* assed enough to drive even remotely properly.
You're assuming the position of the filmer, which isn't necessarily correct.
I'm not going to say the guy in the black car shouldn't have been more careful, because you should always be more careful, but the one at fault here is no doubt the people standing in the middle of the road.
If you can't tell the filmer is in the immediate left lane of the collision, then I feel you need to get your eyes checked. You can see that they move to avoid the black car after it attempts to move into their lane.

First of all, if you were even remotely road savvy, you'd notice people do this all the time. The black car is clearly attempting to enter the gap that is between the filmer and the vehicle in front of him to avoid the collision.
The driver of the black car could have avoided running the guy over if they had bothered to keep an eye on the road conditions around them, like a normal driver is supposed to, and then using the knowledge that the right lane is open to avoid it.
Second of all, while yes it is correct to assume that the gap in front of the filmer is a big enough gap to fit a vehicle, it simply isn't due to the speed of traffic in that lane. It becomes immediately more dangerous to be the black car in the middle between the filmer and the vehicle that was previously in front of them, as well as the filmer themselves.
If either the black car suddenly slowed down due to the accident, or the other vehicle now in front of it, they'd have caused a second accident due to them both not being able to react appropriately and within moderately safe stopping distances. Slamming on your brakes does not constitute being able to stop safely, by the way.
Lastly, he didn't hit the driver that was filming because, as mentioned in my comment to annoymous, "You can see that they move to avoid the black car after it attempts to move into their lane." This is likely because the filmer is actually paying attention like they should.
Now, if I want to get really technical here, I could place most of the blame on the SUV in front of the black car. Providing one knows how to drive properly, they should be paying attention to as much as the road around them as possible, but most importantly the front and well beyond that, if applicable.
It is clearly day in the gif, as well as relatively clear weather, so those should be taken into consideration. Under that consideration, drivers should be have unlimited visibility, and therefore should be checking at least half a mile or kilometer down the road where possible.
You notice the SUV notices that there is an accident in front of them, only just too late because they weren't paying enough attention to what is not just in front of their vehicle, but traffic further down the road as well. This with consideration to the previous paragraph.
Because of this, you could argue the driver of the black car reacted accordingly and actually did what they could to avoid rear ending the SUV on top of the SUV rear ending and pinning someone between their bumper and the vehicle they just collided with. This is because the SUV in front of the black car should have been braking and attempting to change lanes as immediately and safely as possible because they should have seen there was an issue in front of them, but they clearly did not.
If they couldn't for some reason, like a vehicle in front of them was blocking their view and they didn't see it until after THAT vehicle switched lanes, that just means they were following far too closely for the speeds on that given stretch of road.
Therefore, in final conclusion, the driver of the SUV is a driver that wasn't paying attention to the road, and therefore assisted in causing a second and third accident. The second accident was SUVs fault with pinning the person between the vehicles due to general lack of attention to the road, the third was the black car running into the other person in the gif due to lack of attention the road around them. Because of this, both drivers should likely be fined, as well as paying for medical and other costs of the persons that were injured.

Simple, they're either not in a car, as I suspect they are actually on a motorcycle, there is a shoulder to their immediate left, or they noticed their immediate left lane was empty enough to go into without endangering other drivers.
