Coincidentally, hanging is the method Japan uses to hang its criminals. Another fun fact is that Japan has a 99% conviction rate; meaning that if you're arrested, there's a 99% chance you're going to stay in prison. I don't know if this is related to Japan not having a citizen jury and only a panel of judges or not.

Japan's legal system is actually really ****** up. The reason they have a 99% conviction rate is because they force a confession from suspects. They are allowed to keep suspects without charge for something like 30 days, during which time japanies police have been known to torture the suspects and make them sleep deprived to try to get them to confess... And if police can't solve a murder they will call it a suicide, which is why their murder rate is so low and their "successful conviction" rate is so high.

I was under the impression of the opposite in Japan actually,
Minors for example are protected by minors laws or some **** , so even the worst kids don't get full punishment, also, I've heard that in cases of mental diseases you can be declared something some such and basically get off scott free or a lesser penalty. idk, Japan gives off this strange vibe where it's actually rare enough to be a criminal that they are ****** at dealing with them. Or something like that.

DAs in Japan typically only take on cases that they are sure they can win.

Its not that they win all of their cases, its just that they only chose to pursue what they think that can win. Otherwise they just settle.

You're close but no, getting arrested doesn't mean that there's a 99% chance you're going to prison. Just like in the US, Japan has prosecutors that can decide whether or not to take a person who has been charged with a crime to court.

The difference is that in Japan, the prosecutors have access to full court logs and ruling histories of the judges. With this information, the prosecutors in Japan know how a judge tends to behave and how they tend to rule on particular types of cases.

If the prosecutor is deciding whether or not to take a criminal who committed crime 'A' to court and they see that the judge they're going to get typically finds crime 'A' offenders not guilty, they'll decide not to prosecute with the mindset of "well why waste time and resources when we know the judge is going to find them not guilty?"

This works both ways though. If the criminal commited crime B and the prosecutor knows that the judge will more than likely convict for crime B, they'll take it to court knowing that they should have an easy win. Its because of this that Japan has such high conviction rates.

List of the last meals of inmates on death row, all of whom were presumed innocent after their execution as new evidence came to light. These were innocent men who didn't commit the crimes they were accused of yet were still put to death, one of whom was presumed innocent years BEFORE his execution and he was still killed. Again, some innocent people are going to be imprisoned. That's just a fact of life. In America, you have to be 99% certain that someone is guilty. So logically, about 1% of prisoners are going to be innocent. Sucks, but what can you do? Make it harder to convict? Then you're just going to have a lot more guilty people going free and you're STILL going to have some innocent people going to prison. Grow up and accept harsh realities.

I point out innocent people have been put on death row and executed and you say "innocent people get punished, grow up." That was never my point. I'm simply stating that even innocents can get the harshest punishments wrongfully, and according to you, you would still claim these people as monsters because they got put on death row. I never said that everyone who makes it to death row are 100% guaranteed to be guilty, you misunderstood. I'm saying that, of the prisoners that are guilty (didn't think I had to say that), the ones in death row are deserving of a punishment such as not knowing when they are going to die. I wouldn't, for example, suggest that we not tell someone imprisoned for stealing a car (assuming they are guilty as we of course do with ALL prisoners, which is why they are, you know, imprisoned) how long they have before they are released. As stealing a car may make you a bad person, or just a person that made a mistake but it doesn't make you a monster. However, the crimes that send someone to death row (again, this is assuming they are guilty) committed a crime that makes them a monster.

We shouldn't change how we run prisons because, "Oh no, some of them might be innocent" because that undermines the reasons for the prison.

How much better is it than knowing exactly which day is your last, and slowly feeling that dreaded date creep up on you? Living in fear of that number. Sit there in anticipation and go mad as you wait months to die, not enjoying any of it because in the back of your mind, you know that you're doomed. Personally, I'd want a cyanide capsule that I could take on my own terms any time I liked before execution day instead.

There's a lot of talk about the death penalty in Dostoevsky's "The Idiot" and he believes the suspense is the worst part of it all. The sentenced will often think of all the ways they could have done better for themselves, everything they missed out and want to try - they think if they get another chance they will be nearly perfect people and will have an insatiable drive and huge lust for life.
And when they do get acquited, they do just that for a very short while and then they fall back to how they were before.

I believe Dostoevsky traveled around France a bit and got his insight from people sentenced to death by guillotine. He also painted (in words) a good description of someone on the death row.

Japanese are cruel for doing what they do...

Dostoyevsky was himself imprisoned in a Siberian camp for 4 years and he got away from a mock execution.

He wrote house of the dead afterwards.
