The comments section is just filled with "he deserved it for having gauges/you're all sick for thinking he deserved it" posts.   
   
I blame both.   
   
 The guy who placed the lock was a dick and did this to someone else purposely. He has his own fault in it.   
   
The guy with the gauges had the gauges in the first place. That's his part of the fault in it. Yes, that argument, but here's why. I go by the phrase "there are terrible people in the world and always will be. Prepare accordingly."   
   
Argue all you want that the guy who put the lock is entirely at fault, the guy with the gauges still had to go through the horrible process of getting it grinded off of his body with power tools and no amount of punishment will undo that. Ever since gauges became popular, the idea of sticking padlocks in them has been around. It's known about. Now not having a little foresight and seeing all of these potential problems that could occur by getting gauges, especially such large ones, he made himself more prone to these problems. He could have easily protected himself from predictable harm with different choices but didn't, and is therefore at partial fault.   
   
People are who they are and can do what they want with their bodies but when they ignore the risks and it goes south on them I don't have any sympathy.
