Security fraud? What exactly did he do?
#254 to #3 - anon (12/18/2015) [-]
He pissed off the government by making a lot of money adjusting the prices of drugs that should be readily available to those that need them, so the government arrested him and will subsequently sieze his assets before turning around and continuing to sell those same drugs for inflated prices at their own profit.

A security is the stock of a company, which is valued based on the assets of the company. He lied about the value of the assets his company had which means that the securities of his company were not worth nearly what he claimed they were. That's fraud because you're warping the projected value of the company that investors use to make decisions.

User avatar #57 to #39 - chickenmcgurk (12/18/2015) [-]
Sort of. It's on a much larger scale what Enron did. Take out the million and put in a billion for the article. That's closer to what Enron did. Plus ruining several lives of investors and almost all of their employees who chose to max out their 401K deposit match from the company.
User avatar #71 to #30 - lazorman (12/18/2015) [-]
Belfort ran "pump and dump" scams, where securities you hold are aggressively marketed to artificially inflate prices before you "dump" them and cause it to crash
Shkreli is accused of something more along the lines of a ponzi scheme, where new investor capital is used to pay off older debts

He lied about value of (one of) his business(es) to get investors. That's illegal because if it wasn't, investors could lose money on people claiming they have a lot while they have nothing(and therefore can possibly earn nothing, bringing losses)

User avatar #19 to #15 - afaik (12/17/2015) [-]
Well, whether or not you get caught doing something still pertains to how you reduce your risk of getting caught. He clearly didn't take all the right measures to not get caught in his act, and that's exactly what happened.

Then again, I should probably have worded it in a way that condemned his actions. Well, balls to me.

No biggie. So can I. I'm just a bit annoyed by the whole deal about this guy. "He did something he was allowed to do! We should shank the ****** because it's highly inconvenient!", so I try to speak from a point of view indifferent to his actions as well as morals. Not that I'm absolutely non-biased, but at least I try.
User avatar #22 to #21 - iwillrulenorway ONLINE (12/17/2015) [-]
I mean yeah, from a legal standpoint it's fine. which is probably why he didn't go to jail before.

from a moral standpoint however it's pretty nonredeemable.
User avatar #24 to #22 - afaik (12/17/2015) [-]
The moral standpoint exists to decide what actions we ought to take to me more accepted into our society. If he values one thing over another, he will choose that thing over the other. He didn't care for how much others would like him for the act, and he disregarded that factor and acted accordingly. Doesn't change the fact that it was detrimental from a financial standpoint. Same goes for the fraud act.
#132 to #5 - skebaba ONLINE (12/18/2015) [-]
So it wouldn't had been a fraud, if the investor hadn't lost, then? It'd still have to be a fraud, since he lied, no matter the outcome.

I think he pissed off a bunch of big pharma people when he raised the cost of the drug to an absorbent amount because it showed the cost of the drugs dont have to reflect the cost of making it. He may have done it just to be a butt, but it showed theres no system in place to regulate people from doing this in "small doses", pun intended so that no body notices. I understand its a business and they need to make a profit, i am not arguing that. However, this cant be the only drug that is over priced due to greed even if its a few $ more than it should be.

User avatar #190 to #186 - hasinvadedyou (12/18/2015) [-]
you arent understanding i said i understand theres a room for profit that needs to be maintained. However, whos to say where they margin of profit should end and excessive greed begins? obviously theres nothing in place to stop someone from marking up medicine by 5000% except media coverage which turns to pressure to lower it. But what about the companies who nickle and dime over where they "should" stop just because 'who is going to stop them?'. The whole healthcare system, atleast in america, is bloated and priced hundreds of times more than it should be in some cases just because they expect everyone to have insurance. But then even if you have insurance if you have the wrong kind of insurance you can still end up paying retarded amounts because they price it for more premium insurance companies. I think it was Time magazine who did a story a few years ago that uncovered hospital to hospital is pretty much priced based on factors like how expensive their machines were along with other factors, not limited to "because i feel like it". Which is the same thing big pharma is able to do. Someone posted a video in this thread about how they can take steps to monopolize medicine for months or years thanks to FDA regulations. Its all pretty ****** atm.

Its ok, you dont have reading comprehension. No one said he increased it by a few dollars the last sentence is referring to what other drugs may possibly be higher in cost even if its just a few dollars more. Hinting at the drugs that we dont know are over priced because they arent increased by 5000%, maybe just 25% or 200% more than they should be.

Reality Check: FDA and Greed To Blame For Rising Drug Prices, Not Capitalism A short vid explaining why the dude was able to do what he did with little consequence
#187 to #64 - hongkonglongdong (12/18/2015) [-]
>fda and greed
>not capitalism
Uh, okay, sure, but that kind of argument goes for anything. I mean, the holocaust wasn't (and I'm not being sarcastic here) down to Nazism or nationalism or fascism; it was down to the Nazi high command and hatred. Likewise, the Holodomor wasn't down to Communism; it was down to Stalin and cold paranoia.

And if you look at that, you'll notice that it was all down to human emotion. And human emotion is not exactly something you can just change.
