Oh I get it. I don't get it.

In UK Law, manslaughter is a partial defence for murder.

The most important difference between them is that, for manslaughter, there is no mandatory life sentence, unlike for murder.

It's more complicated than this, but basically, where a person kills another, he is not to be convicted of murder if his acts and omissions in killing resulted from his loss of self-control. And loss of self control cannot be premeditated, there cannot be a considered desire for revenge.

So if you have a bat in your car, it would suggest you premeditated the murder and you could get a life sentence if you can't use manslaughter (loss of control) as a partial defence. Whereas if there's a glove, you can say it was for baseball and you're more likely to get off without a life sentence.

Hope this makes sense and helps a little,

what if you want to add one of those long nails you see in movies and video games and you use the baseball defense with a glove
User avatar #91 to #63 - makethingsworse (11/28/2015) [-]
It's actually a lot more simple than that (though you were correct). A baseball bat is actually considered a lethal weapon. They treat it the same way as an unregistered firearm in your trunk- except the registration in this case would be a baseball glove.

TL;DR the baseball glove gives you apt excuse for having a baseball bat. You ain't gotta explain **** , you play baseball.

(I have a baseball bat in my trunk and have had a cop explain this to me)

Where I said 'It's more complicated than this', it was because there are several other tests that one must be put through in deciding if it's manslaughter. That little paragraph sums up pages and pages of legislation on the topic.

And I was giving it context.
User avatar #105 to #102 - makethingsworse (11/29/2015) [-]
Yeah dude I understand. You were putting it in a scenario where there would evidence against you in the event one might end another's life. I was just putting into a more everyday context. Like if a cop was searching your trunk, for example.

Love you, Pookie. Never meant to steal yo thunda

Wait, you get a life sentence for murder?
#69 to #63 - ninjatofu (11/28/2015) [-]
Well done.
User avatar #2 to #1 - izaya (11/28/2015) [-]
Well. Severeness of murder is determined by whether you planned it or if it was in the heat of the moment or even accidental.

If you carry around both bat and the glove, you can just say you play baseball for fun and just happened to have a bat, which you in the heat of the moment, of course, used as the weapon. If you have only a bat, you'll have a hard time proving that you weren't carrying it with the intent to kill that someone, which would make your crime a lot worse.

I'm not good with law or explaining, please notify if there was something I missed out.

Useless advice tbh

First thing the prosecution is gonna ask is for evidence that you actually play it. Which you won't have.

Probably be better off having a toolbox in your car

actually, both mens rea and actus rea can be qualified by taking a baseball bat out of your car

Who the **** do you think you are, coming to my comment and throwing around the juridical terminology like you're some big shot huh?
User avatar #10 to #2 - greyhoundfd (11/28/2015) [-]
Not to mention that if you are attacked outside your car it is much easier to make a self-defense claim if it is apparent that the baseball bat was not kept in the car as a weapon.

You only gotta worry about that in your commie blue states. Here in MS, you can carry a bat as a weapon of self defense and just be open and honest about it. I was pulled over by a state trooper recently and he asked if I had any weapons. I told him there was a pistol in my door, a bat in the back seat and a knife in the glove box; all for self defense. He asked me to take out my gun, and we just talked about how Ruger is a great brand and stuff. No ticket even. I love freedom so much

I was never a big fan of ruger, but I built a 1911 off the frame of one. And it still stands as the most reliable 1911 I've built, only time it didn't chamber was when I wasn't paying attention and limp wristed it.

you have a pic of that 1911?
#100 to #84 - Dropkicksxxx (11/28/2015) [-]
Yep, green grips
#101 to #100 - ethirty (11/28/2015) [-]
and you built it from a ruger frame? Very nice. Wasn't it hard to make things fit or whatever? Using different frames for different models is something ive never heard of.
User avatar #103 to #101 - Dropkicksxxx (11/28/2015) [-]
That's what's nice about 1911, everything is basically standard. Some parts take a tiny bit of filing just to make them run as smooth as possible, but that's usually just extra metal from manufacturing ( some people want a nice 1911 built for 1000$ , so they get cheap parts)
#104 to #103 - ethirty (11/28/2015) [-]
very cool, do you have more pics ?
User avatar #106 to #104 - Dropkicksxxx (11/29/2015) [-]
Bottom, 1911, ati to start, replaced everything I could with Wilson parts, the AR is a bushmaster but has a new carrier and upgraded buffer tube and break

Not the same guy but I always go to Purvis (I think that's how you spell it) every year since I have like 250 acres of land there. Also Ward's and Leatha's barbeque are the ****

How can you say you were going to play baseball without the ball
#4 to #3 - tylevans (11/28/2015) [-]
20+ players and you only need 1 ball. small ratio there
User avatar #5 to #4 - kanekoa (11/28/2015) [-]
Still, you say you're going out to play some ball but now you have to find someone else to cover for you saying he was going to play. With the ball you could say, "I was going to the park to see if anyone there wanted to play some ball" or something.
#8 to #5 - tylevans (11/28/2015) [-]
might as well keep the bases, the 9 inch nails, and a hammer then too
