Cant get charged with open liquor if you are the liquor
User avatar #29 to #17 - thepizzadevourer (01/10/2016) [-]
You can, however, be charged with a DUI.

How can you be under the influence if you ARE the influence?
User avatar #13 - thechosentroll (01/09/2016) [-]
I had to google what "open liquor" means. Holy ******* **** , are you telling me public drinking isn't allowed in the US? What kind of totalitarian regime are you ******* living in?
User avatar #24 to #13 - kennyh (01/10/2016) [-]
Assuming you aren't posting this from the moon it's illegal where you live.
#32 to #24 - herbolifee (01/10/2016) [-]
No, I'm from the Netherlands and here and in every other european country I've been it's perfectly normal to drink beer on the street. It's just another one of USA's retardations to forbid such a simple thing.

Land of the free!
User avatar #43 to #32 - reprieve (01/10/2016) [-]
It's legal some places in the US, Nevada to be specific. I've never had the urge to drink on the street anyhow. I've drank a few on the beach at Lake Erie and as long as you aren't being a **** face about it nobody really cares. it's more for people who are acting up so there's an extra thing to charge them with, like getting pulled over speeding and the cop notices your plates are expired.
User avatar #33 to #32 - kennyh (01/10/2016) [-]
It's illegal almost everywhere in Europe.

But whatever makes you feel superior.

"I can drink in the road without getting in trouble probably!"

Are things so ****** in the Netherlands that that's a point of pride?
User avatar #34 to #33 - herbolifee (01/10/2016) [-]
You can't drink behind the wheel if that's what you mean.
Because if that's what you mean then forget what I said, that ****** dangerous.
User avatar #35 to #34 - kennyh (01/10/2016) [-]
No literally most places in any first world county have some form of open container law. Denmark is the only place listed that doesn't. It's just that (as in the US) most law enforcement ignores it if you aren't in a vehicle.

im just gonna stick my foot in here and tell you it is legal in japan. that is all i know. continue
User avatar #36 to #35 - herbolifee (01/10/2016) [-]
Right, I thought they actually actively enforced it in the US, my bad man. I'm actually glad that the laws exist in a passive way so that the cops can easily apprehend people who are being extremely obnoxious because they're drunk.
User avatar #39 to #36 - darktoucan ONLINE (01/10/2016) [-]
he is wrong its not passive, you have open liqour on your step and they will come at ya with the charges
User avatar #25 to #24 - thechosentroll (01/10/2016) [-]
It's only illegal if someone actually enforces it. And they don't. Because it's ******* stupid.
User avatar #51 to #25 - wraithguard (01/10/2016) [-]
The same can be said most places in the US. In fact, we have many old laws that we simply haven't bothered to change, and we just don't enforce. For example, in my state of Oklahoma, it's technically still illegal to have sex before you are married, but nobody cares enough to even bother acknowledging that the law exits.
#28 to #24 - anon (01/10/2016) [-]
It's not illegal in Denmark
User avatar #27 to #13 - ImmortalBaconEater ONLINE (01/10/2016) [-]
In most countries (not just US) you aren't allowed to have open containers of liquor in the passenger area of your car. You can have it in your trunk (I think the back area of an SUV counts too). This is supposed to discourage drunk driving.

According to a quick google search open containers are illegal in almost all of Europe as well but most authorities choose to turn a blind eye. The definition of open liquor is retarded. You can drink in public, like in bars, clubs, food places, your lawn or your neighbours lawn if they let you. Open liquor means you can't walk down the street with an open container of liquor and be drinking it. Yes you can have a bottle that was opened then the lid was placed back on, but open liquor means if the bottle is closed and you aren't drinking it on the street, it's ok.
User avatar #22 to #19 - thechosentroll (01/09/2016) [-]
The street is a prime drinking spot, though. That seems really stupid.
User avatar #44 to #22 - opticmonkey (01/10/2016) [-]
The street's not a prime drinking spot. The law exists so normal people walking on the street don't have to deal with drunk assholes hanging out getting drunk on the street. If you really wanna drink in the street just brownbag it and you would probably be fine
User avatar #23 to #22 - nudybooty (01/09/2016) [-]
Personally it makes sense to me because it a lot harder to keep tract of whos under age and who's not on the street

There is nothing wrong with drinking and driving.
There is nothing wrong with drinking alcohol and them immediately driving.
There is also nothing wrong with drinking alcohol while driving.

As long as you are not driving while inebriated.
And as long as our laws actually follow logic.
User avatar #31 to #26 - marno (01/10/2016) [-]
I think I get what you're saying. But a lot of people are too stupid to know their limits. And drinking laws aren't there to punish the people for drinking. They exist to protect the innocents that are murdered by careless drinkers.

>cops ask guy to step out of the vehicle as driving whie intoxicated is illegal

User avatar #20 to #4 - nudybooty (01/09/2016) [-]
pfft, Ricky is from Canada, they wouldn't taze him or smash the window. They would apologize for any inconvenience. then he'd tell the cops to **** off

User avatar #6 to #5 - Einsty (01/09/2016) [-]
Nada, but if it's bellow 0,02% or something cops will let you off rather than argue about the precision of their measuring equipment.

Student in policing here. Canadian law
A vehicle in motion is not considered a dwelling house. In order for a motor vehicle to be considered a dwelling house it must have bedding and cooking accommodations. It must also be parked off of a road or highway on some form of property that it is permitted to be on.

if I am remembering right, a house can be your home, but a home is not always a house. It is most where you are comfortable/feel safe at, and all that.
