If you are living in the U.S it is illegal for someone with a permit to drive if the supervising adult is intoxicated.

This actually applies to all countries where there's a requirement for a supervising adult, e.g. learner's permit. The supervising person needs to have a valid license and needs to be in a legal condition to drive himself as well.

Well the kid just got their permit, making it their first time (legally) on the road. Maybe they aren't capable or confident they could drive safely

I've driven my mom home from the hospital with no license before.
I felt confident enough having not driven much at the time.
I guarantee if he has his permit, he is confident in his driving.

That's about the time you call up two of your friends, and have one of them pick up the other one, drive to where you are, have one of them be your supervisor driver or whatever, and have the other one bring their car home.

Leave them parents there.
