This person has a point, it's just not the one they're trying to make.
In a small way, I can agree with this. If a woman/man doesn't want it but is scared of making the guy/other woman uncomfortable or doesn't want to make the other person upset, so s/he just kinda lets it happen, then it's technically rape.
Still, that doesn't necessarily make the other person a "rapist." A rapist would be aware that the other party doesn't want it, but does it anyways.
I can see the point you are making so I tossed you a thumbs up but I disagree with it.
Rape implies non-consent. Being uncomfortable or not wanting to make the other person uncomfortable is not not consenting. If he or she doesn't say no and just kinda lets it happen they more then likely consented.
Just because you might not want it, if you let it happen thats not rape. If I suck a dick and never say no but continue bobbing my head on that rod because I don't want to make the dude uncomfortable or blue ball him, I'm not being raped. Just means its sex I may not enjoy.
Your version of rape is what gets those cases of women regretting ******* some nasty **** and saying it was rape the next day, lying and saying they never consented because it might piss off their boyfriend.
Now maybe if the person doesn't want to risk upsetting someone to the point of bodily harm. To use the earlier dick sucking example, I'm not liable to suck a dick even feminine futa penis and it don't matter how upset some dude or lady with a schlong might get, probably ain't happening. Now if their upset state means they are going to physically assault me or even kill me, well I might be so inclined to suck a dick to protect myself. That would be rape, I had no real choice in the matter, I was forced because it was the choice of dick sucking or getting my ass beat and not in the maybe fun if I was drunk BDSM way.
Louis C.K. put it best in the cases where there is no outward rejection from the receiving party:
"I never showed a woman my dick without asking first, which is also true. But what I learned later in life, too late, is that when you have power over another person, asking them to look at your dick isn’t a question. It’s a predicament for them."
Like I said, I wouldn't consider someone a rapist if they didn't pick up on the lack of interest from the receiving party. However, as in the case of young children who have no idea what's happening to them, a person in a position of power over someone else, or a sober person
not a drunk person
taking advantage of a plastered/passed out drunk person, refusal may not happen.
I totally agree that if someone has drunk sex with someone else and later regrets it then that's not rape. In the case of drunk dumbasses I couldn't convict someone of rape if it were drunk people being drunk people because alcohol brings out the dumb in everyone.
The Louis C.ucK. case is where one of the few times a power component is overt and while it might not be rape what Louis did it was certainly sexual assault. Louis got away with doing what he did because of the massive power imbalance between him and the women he showed his dick too, like Harvey Weinstein. Any consent was coerced and much of the time consent wasn't even achieved, she or he just never said no. Considerably different of a situation between two teens necking a tool shed.
With children and the disabled (chemically or au naturel) they cannot consent legally and mentally. It is part of the power over someone too. Some little ankle biter or some feeb softhead is not going to be able to even compute what is happening, certainly not enough to fight back or respond.
It all comes back to consent. If someone in a position of power is forcing someone to get freaky with their deacky its not consent even if they say no, a person incapable of consenting will not be able to consent. And certainly in those cases the persons committing the act are rapists, some big boss forcing some intern to suck his dick is at best guilty of sexual assault, some chick or dude feeling up some drunk chick or dude is either sexually assault if not raping them, so on.
One thing douchenozzle feminists get right about rape and sexual assault is it is power plus consenting sex but get wrong the fact any non consensual sex or sexual assault is giving someone power over another. Doesn't matter whether its some billionaire with some pageant beauty, some 90 year old granny with a delivery boy, some not passed out person with a passed out person, or any freaking Terry Huge Black Man Crews. The person is being assaulting them holding power over them, showing they physically, financially, culturally, or socially superior.
The difference between those scenarios and your initial one is the person in your scenario isn't really powerless or a sub or anything, they just are like "meh, don't really want to slap around the johnson of this dude but I don't really want to hurt his feelin's so I'll do it anyway." She didn't really want to do it but like me scarfing down an entire Little Caesars pizza in one sitting she could have not done it if she wanted to, she wasn't forced into it (unlike me, damn those cheap prices!!!!).
And this is literally the first thing i came across on the internet after reading this (a poll on louis ck).
