She has a point though. You cannot force a religious group to do anything. Same for a business. They can refuse to marry gays or serve them, and forcing them to do so is illegal and unconstitutional.

First point:

She is an elected official. She is a part of the government, which means the constitution, is not her defense. The constitution is a defense for the people, from the government, as is the bill of rights.

She can not use either in defense of actions taken while on the job, because while on the job, she is not a citizen, but instead a member of the government.

I.E. As a security guard, I am not considered a government employee, like a police officer would be. Meaning, I do not need a warrant to search you, if you are on property that I am protecting. I do not need probable cause. All I need, is a sign that says you can be searched while on the property.

Point 2: Under no circumstances may an employee of the government discriminate due to race, gender, sexual orientation, or age. The bill of rights gives the citizens this defense.

She's not allowed to allow her religion to take president over her job, as it's said in her oath of office.

She didn't do it because "I don't want to force a church to do something against the church doctorine" she did it because of her own personal views. (which clearly conflcited with her duties and job)

Thus, she should have either ignored her personal feeling or quit her job.

That said, a marriage (in the traditional Christian sense) isn't something that you should be able to force religious groups to give out.

You need a non-religious alternative, one that has the exact same benifits to a "normal" one.

At the moment, all we have is weak-ass civil partnerships, that are missing many of the rights that come with being married.

Well sorta, but marriage licenses are "shall issue" meaning they can't be refused by the clerk. She has the right to uphold her religion but her oath of office requires her to issue legal marriage licenses- conflict of interests there. If her practices of religion are interfering with her ability to do her job she should be terminated or moved to a position which doesn't compromise her belief. Like muslims who work at target- they are put in positions where the don't have to handle any haram products.

In this case, I don't she owns the business. It's a government institution, which means it has to follow laws, whatever they may be. Now the bakery for example, she has every right to not bake their cake. She owns the business.

*I don't think she

Not a business, government institution.

>Defended with muh constitution
>constitution clearly states Supreme Court can't make laws
User avatar #6 to #3 - elsenortamatoe (10/27/2015) [-]
so its an unconstitutional law...

she was a federally employed marriage clerk. not a private church.

As funny as this guy was, I can't help but feel that what he does now is no more trolling than it is a prank when people shout nonsensical crap at random people. You're not annoying people, you're just making people think you're an idiot before they move on with their day, probably with a newly inflated ego.
