I think if you don't report the rape within a day or two (if its a consent issue) then it shouldn't be allowed in court, much like if someone stole something from you and you waited 3-4 days after noticing to call the police.

Drunk sex being considered rape is a joke. Unless the victim is passed out, consenting to sex while drunk should be considered consent so long as the age gap is legal, because literally anything else done while drunk is considered a "you're an adult, be responsible for yourself" scenario.

Child sexual assault survivors are the obvious exclusion to this, as it could be decades before they are able to tell anyone and I do not believe anyone would disagree with this one.

Cases of rape that dont involve children or weapons are almost always a he-said she-said situation. without evidence that the rape occured aside from a statement (no marks, no confession) it's just not feasible to prove "beyond reasonable doubt" that a crime was committed. Our justice system is based on evidence, and if its one persons word vs another its just a joke of a trial for everyone.

When it comes to rape, it can be proven that they did in fact have sex by checking the woman's genitalia for his DNA.

Additionally, police are able to check if someone was slipped a drug. With both of those facts, you can easily deduce that someone was drugged and then raped especially considering how well forensics can estimate time based on evidence.

There should always be a trial at least for it. Assume they are innocent yes, but if it is clear they did something, which there is in self defense cases, then it becomes the rule that you must prove it was in self defense. Now if they are convicted in a case where it was actually self defense, something has gone wrong. But there does need to be some trial in most every self defense case, even if that trial only advances to the grand jury.

I don't really see a way to go at this issue as a whole, though.

I can see why we would want to make sure that there is 100% evidence involved in order to prevent false rape accusations.

But at the same time, most rape accusations are pretty difficult to prove, and some can't be proven at all. So does this mean for rape victims and rapists? Does this mean that we should let rapists off the hook?

This isn't necessarily the worst idea, people'll bitch about muh privicies but just have the cameras not be on any network and have all of the video input directed into a compression program, then a physical medium, then deleted off of everything but the physical copy, with huge fines in place for not keeping the physical media stocked.

Police can claim the physical media with adequate warrants and any destroyed or tampered video will carry with it the full weight of any crime being investigated at the time until innocence is proven by the tamperer.

If we lived in a world where a liar gets hit with a sentence mirrored twofold, and lets say in this world you got 10 years, that would still be only 20 years, not a life sentence

Despite how morally reprehensible it is, its simply not drastic enough of a crime to warrant a life sentence; it didn't do enough damage to justify the permenant end to someones life in the free world

They should be looked down upon for what they did, but there are two things to consider

1. The severity of a punishment should be relative to the severity of the crime, yes false rape claims ruin lives, but so does identity theft, a car theft could cause you to lose your job and family, maybe a theft of your dead wifes locket crushed you and made you become an alcoholic, or back to the false rape claims, there are people whose lives aren't ruined by a false rape accusation, someone who lives alone, stick to themself, with a court battle that goes their way and / or no one around to spread news about his accusation ; there is a gigantic variety of ways a persons lives can be ruined depending on the life any given person leads, its neither a reliable nor suitable way to adjudicate law

2. Its impractical, to simply put it its just not worth the effort to take tens of thousands of mostly young people, remove their economic contribution to society, and pay to feed & clothe and care for them for an entire human lifespan, we already have 2.2 million prisoners, we shouldn't take on more of them for any longer than is necessary, and a life sentence in this case is unnecessary

Probs not a good idea, unless you can train to the level of One Punch Man, they'll just send more cops after you until you get tired.

It's honestly a lot safer to cooperate with the cops and then battle it out in court. In the street cops have all the power, and anything you do against them will be more reason for them to try to put you in jail. But in the court you have some power and the time to present your case. Also, cops will be a lot more willing to cut you some slack if you just show some respect.
